Welcome to Ingesto Platform. Below we present to you ("Visitor") you Terms of Use and Browsing Conditions ("Terms"), a document that sets out the main rules that must be observed by everyone who accesses the website www.Igesto.com.br, its subdomains or uses its tools.
By visiting or using this website it is assumed that you have read and agreed with all of the items below.
A Ingesto is a Portal that mediates the withdrawal of funds (“Contributions”) for designing and developing new products collaboratively, commonly known as Crowdfunding, in English.
For the purposes of this document, the following definitions and descriptions should be considered for better understanding:
Anti-Spam: System that prevents unwanted correspondence such as mass advertising by blocking messages or removing them from a specific folder.
Spider App: Program developed to obtain information automatically on the internet, browsing the web (web) as if it were a spider (spider).

Campaign Developer: Registered user who develops and presents a Campaign, under its exclusive responsibility, to capture contributions for the development of its Project or Product.
Layout: Set comprising the appearance, design and flows of the Portal.
Link: Terminology for internet address.
Logs: Records of visitor activities carried out on the Portal.
Ingesto Platform: Designates the website hosted on www.ingesto.com.br and its subdomains.
Rewards: Products or services that may be offered by the user Campaign Designer to the Collaborating Users, under its exclusive responsibility and without relation to the Ingesto.
Site: Name for internet pages.
Visitor: Anyone who browses the Portal.
User: Every visitor registered on the Portal.
Webmastering: It comprises the creation, programming, development, control and availability of internet pages.

1 – Access and functionality restrictions
1.1. This Portal is dedicated to hosting the website Ingesto Platform, whose activity is to intermediate the collection of funds for the development of new products or projects, known as Crowdfunding.
1.2. Visitors and users are not permitted to access the Portal's programming areas, its database or any other set of information that is part of the Portal's activity. Webmastering, whoever does so is subject to Brazilian criminal law and obliged to repair the damage they cause.
1.3. It is also not authorized to carry out or allow reverse engineering, nor translate, decompile, copy, modify, reproduce, rent, sublicense, publish, disclose, transmit, lend, distribute or, in any other way, dispose of the consultation tools of this Portal and its functionalities.
1.4. 2 – General information about the website and its operation

2.2. 4 – Privacy of visitors and users on the Portal

5 – Portal Obligations
5.1. A Ingesto Platform is obliged to visitors and users and its users to:

6 – Visitor obligations
6.1. Visitors and users are obliged to navigate with ethical integrity, always respecting the conditions that govern the use of the Portal, including but not limited to the Terms.

7 – Copyright and intellectual property of the Portal

7.4. Only a temporary archive of this Portal and its contents is permitted, and its use for commercial, advertising or any other purpose that contradicts the reality for which it was designed, as defined in this document, is prohibited. The reproduction, distribution and dissemination, in whole or in part, of the texts, figures, graphics that make up this Portal, without prior and express written authorization from Ingesto Platform, with only the printing of copies being permitted for personal use and archive, without separating the parts that allow a faithful and real understanding of its content and objective.

7.11. The eventual removal of any content or functionality from this Portal, as a result of any complaint, must always be understood as a demonstration of our intention to avoid unpleasantness and, never, as an acknowledgment of guilt or any infraction by the Ingesto Platform to the right of a third party.
7.12. Unless specifically provided for in an existing contract between visitors and users with the Ingesto Platform, they retain the copyright of the contents they already possess when they send them to the Portal, such as, but not limited to, comments, videos, images, audio and messages, however, they grant an irrevocable, perpetual, worldwide, unrestricted, license royalties and non-exclusive reproduction, adaptation, modification, translation, publication, distribution or display on the Portal itself, enabling better use of the tool, greater dissemination of any Product, service or activity linked to Ingesto Platform.
7.13. If the visitor or user sends suggestions to the Ingesto Platform through the Ingesto Platform or through publicized channels relating to ideas for new products Ingesto Platform, improvements to existing products, advertising campaigns or any other marketing action to be carried out by Ingesto Platform, they will no longer belong to the intangible heritage of the visitor or user, joining that of the Ingesto Platform, and nothing can be claimed in this regard, especially monetary compensation for what was sent or revisions to the models used.

8 – The features of the Ingesto Portal
8.1. The Portal presents its visitors and users with a platform that enables Developers to present their Campaigns to potential Collaborators. If Employees identify with the Project presented, or with the Product offered, they will be able to contribute financially, enabling the Developer to make their Project. A Ingesto Platform is a mere intermediary, acting in the presentation of the Campaign and receiving resources from Collaborators, on behalf and order of the Elaborators, not having any responsibility for the Campaign, products or projects presented by the Elaborators.
8.1.1. Only users over 18 years of age are allowed to use the platform.
8.1.2. In case of registration of a legal entity, an individual responsible for the account must be indicated, who must meet the age criteria above.
8.1.3. Such as Ingesto Platform is a mere intermediary in the collection of resources, it is not responsible for the success of the Campaign, for the veracity of the information presented by the Developers, nor does it guarantee the delivery of rewards or the viability of the Project presented by the Developers.
8.1.4. If a Campaign is not successful, or in any way a user finds himself frustrated due to untrue information from another published on the Ingesto Platform, The Ingesto will not be responsible for the frustrations and unpleasantness arising from these facts, as it does not act in any way in the development of the Campaign or is responsible for the Contributors' contributions, being merely an intermediary that presents the Campaigns and collects the Contributions on behalf of the Developer.
8.2. The Portal only mediates Contributions from Contributor users, with the values subsequently made available to the Contributor user once the goal established in the Campaign has been reached or exceeded.
8.2.1. Contributions are sent as Donation from the Collaborator to the Elaborator. When a reward is indicated by the Employee, he or she is solely responsible for preparing it and delivering it to the Employee. If the Employee fails to meet the promised deadlines or deliver the rewards, the Employee may use all legal means against the Employee to assert their rights and have their claims met. Ingesto is not responsible for the delivery of rewards, nor for any costs incurred by the Employee if he intends to use legal means to have his wishes met with the Employee.
8.2.2. Campaigns may benefit third parties other than the creator himself, with the latter being responsible for passing on what was collected or the results of the campaign. If Recipient refuse to receive what was offered, employees will not have any rights over what was sent to Ingesto Platform, with the creator remaining the legitimate holder.
8.2.3. In case of non-compliance by the Developer User with any of the provisions of the created campaign, the Ingesto Platform will not be responsible for carrying out what was not fulfilled, especially, but not limited to, delivering a certain Product or perform the promised service. The Collaborating User must seek satisfaction of what was given in commitment through legal means, without any interference, responsibility or intermediation from the Ingesto Platform.
8.3. A Ingesto Platform You may change the eligibility criteria at any time. Also, you have the right to refuse to grant access accounts to any person or entity that has failed to comply with the Terms or legal document of Ingesto Platform and had his access account deleted for this reason.
8.4. By contributing to existing campaigns, contributing users do not acquire any rights to the intellectual property of the content sent by the creating users, nor of the Product or service that will be produced or developed.
8.5. The user is aware that they must be registered with one of the Payment that Ingesto Platform accepted on your platform. Therefore, you should carefully read the Service Terms so that you can choose which one you will use.
8.5.1. You also agree that when using these platforms, fees may be applied to the amount collected, which Payment is linked exclusively to the movement of capital in the chosen arranger.
8.6. If the creating user offers more than one type of reward, the contributing user can choose the one that best suits him/her at the time of contribution, as long as it meets the minimum value required.
8.7. A Ingesto Platform reserves the right not to publish or delete campaigns and content sent by users, at any time, without prior notice and without any right to compensation to anyone, which contain:
Racism or discrimination of any nature;
Bullying, Stalking or any other type of illegal embarrassment or harassment;
Manifests violation of copyright or image rights;
Use of brands, symbols, logos or emblems of third parties;
Instigation or support for the commission of crimes, such as drug trafficking or use, rape, homicide, embezzlement, among others;
Manifests the practice of an act contrary to the law, public order or good customs;
Use of violence, dissemination of hate or any other form of aggression against someone's physical well-being;
Commercial activity similar to Ingesto or that uses the platform to raise resources through third-party advertising instead of regular interaction in the environment;
Errors or suspected mistakes.
8.8. Visitors will be able to use the "Contact us" every time they witness or verify inappropriate content on the website.
8.8.1. The report will be confidential and will preserve the visitor's identity.
8.9. Content sent by users and published on Ingesto Platform should not be interpreted as the opinion of the Ingesto, nor a declaration of agreement with what was published. Users are entirely responsible for the content they submit to the Portal.
8.10. Users authorize Ingesto Platform to widely disseminate ongoing campaigns and those who promoted collaborations in the most diverse media, in order to encourage greater participation in activities by other people and increase the chance of campaign success, without the requirement of Remuneration or any consideration resulting from such dissemination.

9 – Campaign and Payment modalities
9.1. “0% or 100%”: The “0% or 100%” campaign is defined for a period of 1 to 90 days in which the creating user establishes a minimum amount for collection and, if it is not reached at the end, the contributions will be returned to the respective users.
9.1.1. If the campaign reaches or exceeds the established goal, the total amount raised will be transferred to the account of the user creating the campaign, except for 10%, value due to Ingesto Platform for the services of Ingesto Platform which will be automatically retained at the time of shipment, in addition to any applicable taxes and the fees of the arrangers of Payment and financial institutions involved.
9.1.2. If the campaign does not reach the established goal, the contributions will be returned to the Operator's account or the contributing user's credit card within 30 days after the end of the campaign, which can be reallocated to another ongoing campaign or request a refund, whenever requested in up to 120 days of effective Payment, if you use PayPal, Tripe, or 170 if you use Paypal. 9.1.2.1. Payments made by credit card will be automatically refunded and the amount will be returned on the next or subsequent credit card bill, according to the card's expiration date and the date of the refund request;

If the campaign reaches or exceeds the established goal, the total amount raised will be transferred to the account of the user creating the campaign, except for 10%, the amount owed to Ingesto for the services of the campaign. 9.2.2. If the campaign does not reach the established goal, the total amount raised will be transferred to the account of the user creating the campaign, except for 10%, the amount due to Ingesto Platform for the services of Ingesto Platform which will be automatically retained at the time of shipment, in addition to any applicable taxes and the fees of the arrangers of Payment and financial institutions involved.
9.3. “Initial Contribution Ingesto Platform": A Ingesto Platform out of mere liberality, and for believing in the Campaigns created on the Portal, undertakes to make the first contribution to every new Campaign launched on the Portal in the minimum amount of R$ 10.00 (ten reais).
9.3.1. This value will be visible from the start, but will only have its Payment effective if the Campaign receives another contribution(s) that adds up to a minimum of R$ 500.00 (five hundred reais). In this way, the Initial Contribution Ingesto Platform will not be effective and/or due if the final value of the additional contributions does not reach the minimum value mentioned. A Ingesto Platform may choose to make larger initial contributions and the Payment effective of these values will always be conditional on campaign collection 50 times bigger than the prize awarded.
9.4. A Ingesto Platform reserves the right to only include the Campaign in its list of Campaigns available for search and location on the Platform after the second contribution received has been made.
9.5. All transactions and operations will use the Brazilian Real as exchange rate (BRL). The campaign developer user is responsible for Payment of all taxes and service fees related to the use of the Ingesto Platform, which can be automatically deducted by the Ingesto Platform, to avoid tax evasion.
9.6. The campaign calculation period has ended, reaching the fundraising objective (if it exists), regardless of its species, the Ingesto Platform will transfer the amounts collected to the preparing user in the period up to 20 working days upon receipt by the arrangers of Payment. The amounts received by the preparing user will already be reduced by applicable taxes and fees.
9.7. The contributing user is solely responsible for monitoring the evolution of the campaign, through information provided by its creator and, alternatively, through details sent by the Ingesto Platform. Therefore, you are aware that the Ingesto Platform There is no obligation to send statuses about campaigns.
9.7.1. It is the sole responsibility of the contributing user to find out whether the campaign was successful or not, and whether credit was returned to their account, so that they can reinvest the contribution or request a refund. The portal Ingesto Platform will not measure efforts to keep the contributing user updated about the success or failure of the campaign supported by him, which will not represent any responsibility on the part of the Ingesto Platform, with which its users expressly agree.
9.8. Also, the Ingesto Platform does not have any responsibility, directly or indirectly, for the information provided by the campaign creator, whether in relation to its development, rewards offered, execution time or related to any other type of detail.
9.9. A Ingesto Platform does not offer any Guarantee in relation to the contributions made by the arrangers of Payment nor is it responsible for credit card failures or bank transfers, as payment platforms are independent of the Ingesto Platform.
9.10. The amounts refunded to the user's account that are not refunded or given in support of another active campaign within 1 year of their return will be automatically retained by the Ingesto Platform and intended for the Internal campaign or Reward of the Ingesto Platform or in the absence of an Internal/Reward campaign, the value will go to the campaign that leads the popularity ranking, that is, that has the highest activity rate.

3. The COLLABORATOR USERS commits to:

4. Ingesto Platform is not responsible:
4.1. For non-compliance with the rewards offered by CREATOR USERS, just like the possible failure of the Project described in the campaign;

8 – The features of the Ingesto Portal
8.1. The Portal presents its visitors and users with a platform that enables Developers to present their Campaigns to potential Collaborators. If Employees identify with the Project presented, or with the Product offered, they will be able to contribute financially, enabling the Developer to make their Project. Ingesto is a mere intermediary, acting in the presentation of the Campaign and receiving resources from Collaborators, on behalf and order of the Elaborators, having no responsibility for the Campaign, products or projects presented by the Elaborators.
8.1.1. Only users over 18 years of age are allowed to use the platform.
8.1.2. In case of registration of a legal entity, an individual responsible for the account must be indicated, who must meet the age criteria above.
8.1.3. As Ingesto is a mere intermediary in the collection of resources, it is not responsible for the success of the Campaign, for the veracity of the information presented by the Developers, nor does it guarantee the delivery of rewards or the viability of the Project presented by the Developers.
8.1.4. If a Campaign is not successful, or, in some way, a user finds himself frustrated due to untrue information provided by another on the Ingesto Portal, Ingesto will not be responsible for the frustrations and unpleasantness resulting from these facts, as it does not act in any way in the development of the Campaign or is responsible for the Contributors' contributions, being merely an intermediary who presents the Campaigns and collects the Contributions on behalf of the Developer.
8.2. The Portal only mediates Contributions from Contributor users, with the values subsequently made available to the Contributor user once the goal established in the Campaign has been reached or exceeded.
8.2.1. Contributions are sent as Donation from the Collaborator to the Elaborator. When a reward is indicated by the Employee, he or she is solely responsible for preparing it and delivering it to the Employee. If the Employee fails to meet the promised deadlines or deliver the rewards, the Employee may use all legal means against the Employee to assert their rights and have their claims met. Ingesto is not responsible for the delivery of rewards, nor for any costs incurred by the Employee if he intends to use legal means to have his wishes met with the Employee.
8.2.2. Campaigns may benefit third parties other than the creator himself, with the latter being responsible for passing on what was collected or the results of the campaign. 8.4. By contributing to existing campaigns, contributing users do not acquire any rights to the intellectual property of the content sent by the creating users, nor of the Product or service that will be produced or developed.
8.5. The user is aware that they must be registered with one of the Payment that Ingesto accepts on its platform. Therefore, you must carefully read the respective Terms of Service to choose which one you will use.
8.5.1. You also agree that when using these platforms, fees may be applied to the amount collected, which Payment is linked exclusively to the movement of capital in the chosen arranger.
8.6. If the creating user offers more than one type of reward, the contributing user can choose the one that best suits him/her at the time of contribution, as long as it meets the minimum value required.
8.7. Ingesto reserves the right not to publish or delete campaigns and content sent by users, at any time, without prior notice and without any right to compensation to anyone, that contain:
Racism or discrimination of any nature;
Bullying, Stalking or any other type of illegal embarrassment or harassment;
Manifests violation of copyright or image rights;
Use of brands, symbols, logos or emblems of third parties;
Instigation or support for the commission of crimes, such as drug trafficking or use, rape, homicide, embezzlement, among others;
Manifests the practice of an act contrary to the law, public order or good customs;
Use of violence, dissemination of hate or any other form of aggression against someone's physical well-being;
Commercial activity similar to Ingesto or that uses the platform to raise resources through third-party advertising instead of regular interaction in the environment;
Errors or suspected mistakes.
8.8. Visitors will be able to use the 'Contact Us' channel whenever they see or verify inappropriate content on the website.

9.1. “All or Nothing”: The “All or Nothing” campaign is defined for a period of 1 to 60 days in which the creating user establishes a minimum amount for collection and, if it is not reached at the end, the contributions will be returned to the users related.

If the campaign reaches or exceeds the established goal, the total amount raised will be transferred to the account of the user creating the campaign, except for 10%, the amount owed to Ingesto for the services of the Ingesto Portal that will be automatically retained at the time of sending, in addition to any eventual applicable taxes and the fees of arrangers of Payment and financial institutions involved.
9.1.2. If the campaign does not reach the established goal, contributions will be returned to the contributing user's Paypal, Tripe, Wirecard or credit card account within 30 days after the end of the campaign, which can be reallocated to another ongoing campaign or request a refund, whenever that requested within 120 days of effective Payment, if you use PayPal, or 170 if you use Paypal, Tripe, Wirecard, as follows:
9.1.2.1. Payments made by credit card will be automatically refunded and the amount will be returned on the next or subsequent credit card bill, according to the card's expiration date and the date of the refund request;
9.1.2.2. Payments made by bank transfer or bank slip will be refunded by transferring the amounts made available in the user's account to their Wirecard/PayPal/Tripe account, in addition to any applicable taxes and the fees of the service arrangers. Payment and financial institutions involved.
9.2. “Flexible”: The “Flexible” campaign is defined for a period of 1 to 60 days in which the creating user establishes a minimum amount for fundraising and, if it is not reached at the end, will take advantage of the amounts that were gathered for your campaign.

If the campaign reaches or exceeds the established goal, the total amount raised will be transferred to the account of the user creating the campaign, except for 10%, the amount owed to Ingesto for the services of the Ingesto Portal that will be automatically retained at the time of sending, in addition to any eventual applicable taxes and the fees of arrangers of Payment and financial institutions involved;
9.2.2. If the campaign does not reach the established goal, the total amount raised will be transferred to the account of the user creating the campaign, except for 10%, the amount owed to Ingesto for the services of the Ingesto Portal that will be automatically retained at the time of sending, in addition to any taxes incidents and the fees of arrangers Payment and financial institutions involved.
9.3. “Ingesto Initial Contribution”: Ingesto, out of mere liberality, and for believing in the Campaigns created on the Portal, undertakes to make the first contribution to every new Campaign launched on the Portal in the amount of R$10.00 (ten reais).
9.3.1. This value will be visible from the start, but will only have its Payment effective if the Campaign receives another contribution(s) totaling a minimum of R$500.00 (five hundred reais). Therefore, the Initial Contribution Ingesto will not be effective and/or due if the final value of the additional contributions does not reach the minimum value mentioned. Ingesto may choose to make larger initial contributions and the Payment The actual amount of these values will always be conditioned on the campaign raising 50 times greater than the prize awarded.
9.4. Ingesto reserves the right to only include the Campaign in its list of Campaigns available for search and location on the Platform after the second contribution received has been made.
9.5. All transactions and operations will use the Brazilian Real as exchange rate (BRL). The campaign developer user is responsible for Payment of all taxes and service fees related to the use of the Ingesto Portal, which can be automatically deducted by Ingesto, to avoid tax evasion.
9.6. Once the campaign's calculation period has ended, reaching the fundraising objective (if any), regardless of its type, Ingesto will transfer the amounts collected to the elaborating user within a period of up to 14 working days after receipt by the campaign arrangers. Payment. The amounts received by the preparing user will already be reduced by applicable taxes and fees.
9.7. The contributing user is solely responsible for monitoring the evolution of the campaign, through information provided by its developer and, alternatively, through details sent by Ingesto. Therefore, you are aware that Ingesto has no obligation to send statuses about campaigns.
9.7.1. It is the sole responsibility of the contributing user to find out whether the campaign was successful or not, and whether credit was returned to their account, so that they can reinvest the contribution or request a refund. The Ingesto Portal will spare no effort to keep the contributing user updated on the success or failure of the campaign supported by them, which will not represent any responsibility on the part of Ingesto, to which its users expressly agree.
9.8. Also, Ingesto does not have any responsibility, directly or indirectly, for the information provided by the campaign creator, whether in relation to its development, rewards offered, execution time or related to any other type of detail.
9.9. Ingesto does not offer any Guarantee in relation to the contributions made by the arrangers of Payment nor is it responsible for credit card failures or bank transfers, as the payment platforms are independent of the Ingesto Portal.
9.10. The amounts refunded to the user's account that are not refunded or given in support of another active campaign within 1 year of their return will be automatically retained by Ingesto and allocated to Ingesto's Internal or Bounty campaign or in the absence of a Internal/Bounty campaign, the value will go to the campaign that leads the popularity ranking, that is, that has the highest activity rate.

The Ingesto website is an environment based on trust, both by USERS CREATING campaigns and USERS CONTRIBUTORS. Therefore, if you do not agree with these provisions, do not proceed with creating your campaign.
1. This TERMS consolidates the good faith commitment of the CREATOR USER with Ingesto and the CONTRIBUTOR USERS of its platform, in addition to the Terms of Use of the Ingesto website, the knowledge and agreement of which by the CREATOR USER are mandatory, with the following conditions:
2. Ingesto undertakes to:
2.1. Provide space on your platform for the dissemination and visibility of campaigns created by CREATOR USERS, in order to allow them to raise funds according to the chosen modality, “All or Nothing”, or “Flexible”, through the use of one of the founders in Payment made available.
2.2. Keep the amounts donated by CONTRIBUTOR USERS and, depending on the outcome of the campaign, transfer the amounts to the user who created it or return the amount to the participants, according to the characteristics of the campaign;
2.3. Make your efforts to allow only suitable and lawful campaigns in your environment. Therefore, you have the right not to defer, publish, remove or terminate any campaign that contradicts the legislation in force in Brazil or the Terms of Use of the Portal, without any right to compensation to the CREATOR USER and returning the amounts donated by the CONTRIBUTING USERS;
2.4. Notify CONTRIBUTOR USERS of the results of the campaigns created and requesting action, if applicable.
3. THE CREATOR USER undertakes to:
3.1. Develop your campaign based on the principles of good faith, veracity and legality, fully complying with the Terms of Use of the Ingesto Portal, under penalty of taking the measures indicated in 2.3;
3.2. Execute the reward promises indicated in the description of the campaign created in its strict terms, bearing the costs of shipping, freight, transport, travel and other charges that are necessary to satisfy the indicated promise, under penalty of suffering legal measures brought by the CONTRIBUTING USERS;
3.3. Assume all legal demands that are motivated by its own action or omission, and must request the exclusion of Ingesto from the dispute and compensate it for expenses arising from legal fees and losses and damages it causes, in accordance with the law.
3.4. Recognize Ingesto’s right to retain the amounts relating to the Services provision for organizing, publicizing and hosting your campaign at the time of transmitting the amounts raised, depending on the chosen modality.
3.5. Previously authorize the possibility of Ingesto providing its registration data to CONTRIBUTOR USERS whenever there is a breach of the promise of reward or a harmful event against them, in addition to recognizing the legitimacy of this act by agreeing to this TERM OF COMMITMENT.
3.6. Not to take legal action against Ingesto or CONTRIBUTOR USERS if the campaign does not achieve the expected success, regardless of the reason, cause or reason, especially due to acts carried out by CONTRIBUTOR USERS that frustrate Donation already accomplished or, in some way, regret it.
3.7. In the event of cancellation or dispute of Payment of any contribution made to the campaign, Ingesto is authorized to deduct, at any time, the value of the canceled or contested contribution, from the total fundraising of the campaign.
In the event that the CREATOR USER has already received the total amount raised in the campaign, Ingesto may, at its sole discretion, charge the value of the canceled or disputed contribution to the CREATOR USER, by sending a billing slip and/or any other accepted means of billing.
Ingesto reserves the right, in the event of failure to Payment of the amounts mentioned above, use all collection methods accepted by Brazilian legislation and even communicate the Participant's default to credit protection bodies and entities.
4. Ingesto is not responsible for:
4.1. For measures taken by CONTRIBUTOR USERS that aim to frustrate the Donation now conferred, regardless of its reasons, causes or reasons;
4.2. Due to the unavailability of the Portal, however, it endeavors to ensure that it remains as operational as possible, as already described in the Terms of Use of the Ingesto website;
4.3. For the frustrations that the CREATOR USER may suffer as a result of the outcome of the campaign they promoted. Ingesto does not have the legitimacy to interfere or control what CONTRIBUTOR USERS will perform.
4.4. For the acts carried out by the founder of Payment chosen, such as the value of the fees and discounts applied due to custody, storage, withdrawal, conversion of the amount or other act that implies Payment for the service Hired, in accordance with the law and the Terms of Service of the corresponding settlor.
5. This TERM OF COMMITMENT is governed by the laws of the Federative Republic of Brazil and by the International Treaties and Conventions to which Brazil is a signatory, and must be interpreted in the Portuguese language, with the Court of the District of the Capital of the State of São Paulo being elected, with express waiver of any other, however privileged it may be or may become, to resolve any doubt, pending issue or dispute arising from this contract.
Welcome to the Ingesto Portal. Below we present to you (user) the Terms of Use and Browsing Conditions, a document that lists the main rules that must be observed by everyone who accesses the MONTHLY CONTRIBUTION CLUB or uses its tools.
By visiting or using this website it is assumed that you have read and agreed to all the terms below.
1. Acceptance of the Term
1.1. By using Ingesto's recurring platform in any way, including, but not limited to, visiting or browsing the website and publishing or contributing to recurring campaigns, you agree to these Terms of Use, which include the Privacy Policy, as well as the rules operational and procedures that may be published on the website from time to time.
1.2. Recurring campaign services are only available to people who have the legal capacity to contract them. Children under 18 (eighteen) years of age, or any person who does not have full civil capacity, cannot use them.
2. Purpose of the Monthly Contribution Club
2.1 Objectives and tools
2.1.1 The platform's objective, through its website, is to provide Users with a space to promote initiatives of any topic or scope, which cause some type of positive impact and require monthly financial collection for their activities. The MONTHLY CONTRIBUTION CLUB therefore makes it easier for Users to get to know each other, serving as a meeting point between people who need resources to make their initiatives viable, hereinafter referred to as “Creators”, and people who are interested in collaborating for the financing, hereinafter referred to as “Contributors”.
2.1.2 As a means of achieving its objective, the MONTHLY CONTRIBUTION CLUB offers tools that make it easier for Creators to make their initiatives viable through the collection of financial resources offered by Contributors in the form of a monthly subscription.
3. How It Works – Basic Rules
3.1 Submitting a proposal and publishing a campaign
3.1.1 The publication of a campaign in the MONTHLY CONTRIBUTION CLUB is and must be done through the steps described in item 4.1, when Creators must respond to a form in which it will be possible to describe the Initiative and make the campaign proposal.
3.1.2 Sometimes it will be necessary to make adjustments to the initial club so that it suits the purpose of the platform. Other times, the club will not fit into the philosophy of the platform and the MONTHLY CONTRIBUTION CLUB team will have the autonomy to refuse such clubs.
3.1.3 Once published, the MONTHLY CONTRIBUTION CLUB will have its own page on the platform, through which Contributors will be able to contribute monthly subscription amounts starting at R$10.
3.1.4 The responsibility for the dissemination and fundraising of Contributors lies exclusively with the Creator, with the MONTHLY CONTRIBUTION CLUB team only facilitating this process, so that it cannot be held responsible for the success of the fundraising.
3.2 Contribution and Payment
3.2.1 To collaborate with a campaign, the User must (i) enter the campaign page in question; (ii) click on the call for support button; (iii) enter your login details or fill out the registration form (iv) read and accept the MONTHLY CONTRIBUTION CLUB Terms of Use; (v) enter your data Payment, which will be passed directly to the Wirecard operator, as described in item 5.1.
3.2.2 Every collaboration made for a campaign on the MONTHLY CONTRIBUTION CLUB platform is a monthly subscription. When making a contribution, the Contributor declares that he or she is aware that the same amount will be deducted from his or her credit card every month, until the subscription is canceled by the Contributor or for some other external reason, such as lack of Payment, for example.
3.2.3 The first Payment It is done at the time of collaboration and from then on all payments will be deducted on the same day in the following months.
3.2.4 From the first Payment, the Contributor joins the campaign's list of Subscribers. If the subscription is canceled for any reason, the User will no longer be part of the Subscriber list.
3.2.5 The Contributor may modify the value of their subscription or cancel it at any time they deem appropriate.
3.2.6 The Creator will have access to the complete list of collaborations and their respective Contributors, including their registration data.
3.2.7 All transactions are managed by the Payment Paypal (paypal.com), or Tripe (tripe.com), including the data security part.
3.3 Goals and Rewards
3.3.1 The continuous fundraising system offered by the MONTHLY CONTRIBUTION CLUB establishes that goals must be designated by the Creators as a way of communicating to all Users the destination of the resources, as well as motivating collaboration and creating significant milestones throughout the process.
3.3.2. Goals are monthly financial amounts that the campaign wants to achieve for specific purposes. Each goal is made up of 03 (three) basic components: Financial value: the monthly fundraising amount you want to achieve; Delivery proposal: what will be done with the money if that amount is collected monthly; Reward proposal: a reward to be delivered to contributors.
3.3.3. Rewards are always linked to goals and are based on the concept of celebration. Unlike crowdfunding platforms with specific collaborations, in which a reward is delivered for each collaboration, in the MONTHLY CONTRIBUTION CLUB rewards are delivered whenever a goal is reached, as a way of marking this important moment.
3.3.4 Rewards can be products, services, experiences (participation in courses, parties, workshops, etc.) or even symbolic (thanks, recognition, name in credits, etc.).
3.3.5 It is not permitted to offer financial rewards as an incentive for collaborations, including, but not limited to: offering equity participation in for-profit entities or any type of security, as well as the promotion of raffles and sweepstakes. It is clear to Contributors, therefore, that financial contributions cannot be made for the purpose of financial return.
3.4 Benefits
3.4.1 Initiatives are encouraged to offer benefits to their Contributors, such as the right to vote on a specific issue, access to internal information or participation in some type of event, for example. This is a way of encouraging collaborations by giving the Contributor a leading role within the Initiative, transforming it into an active agent within the process. These benefits have nothing to do with the rewards, explained in item 3.2, which mark the achievement of a specific financial goal.
3.5 The Role of Intake and the Creator's Sole Responsibility for Implementation
3.5.1 The MONTHLY CONTRIBUTION CLUBE platform only offers the structure of its website and does not participate in the creation of the initiatives published on it, nor in their implementation. The campaigns run, the execution of objectives and the delivery of promised rewards are the exclusive responsibility of the Creators. Ingesto is not responsible, therefore, for the way in which resources are used, for the achievement of objectives and for the delivery of such rewards, for their veracity or their quality.
3.5.2. Eventually Ingesto may publish its own campaign. In this case, said information will be expressly published on your website and, solely and exclusively in this case, you will assume the responsibilities of a Creator.
3.6 Possibility of post-moderation
3.6.1 The relationship between Creators and Contributors occurs directly, without intervention from Ingesto, which only provides space on its website. Ingesto does not mediate business through the MONTHLY CONTRIBUTION CLUB platform. Ingesto, although it does not assume responsibility for the content generated by its Users, nor has any obligation to monitor its content, reserves the right to discretionally and at its sole discretion remove any content considered inappropriate from the website.
3.7 The platform’s philosophy
3.7.1 THE MONTHLY CONTRIBUTION CLUB, like O Ingesto, exists to help bring to life initiatives that generate collective impact. For a campaign to be accepted on the platform, it must articulate what type of impact it generates and how the resources mobilized through the MONTHLY CONTRIBUTION CLUB will help expand this impact. All proposals will be analyzed by the MONTHLY CONTRIBUTION CLUB team, who will check whether they are aligned with the philosophy of the platform and Ingesto.
3.7.2 Any campaigns with illegal, immoral, obscene, racist, offensive content or content that is in violation of morality and good customs or current legislation, or that fails to comply with any condition established in these Terms, are not permitted and may be removed from the air. Partisan political campaigns or campaigns with a religious promotion theme will also not be accepted.
4. The Campaigns – Details
4.1 Campaign publication
4.1.1 To publish a Initiative on the website and become a Creator, the User must click on the launch contribution club button, going through the following steps: (i) complete registration; (ii) read these Terms of Use, Privacy Policy and other rules for using the MONTHLY CONTRIBUTION CLUB in full and carefully; (iii) careful reading of the presentation that shows details about the dynamics; (iv) description of the Initiative by filling out the online form; (v) details of the first 3 (three) goals and their associated rewards; (vi) campaign submission and publication on the platform.
4.1.2 If the proposal complies with the conditions established in this term, after the process described in item 3.1 and its sub-items, the Creator will receive a campaign page on the platform, which will be available online to receive contributions from Contributors.
4.1.2. Campaigns that do not comply with the conditions established in this term will be removed from the air. The MONTHLY CONTRIBUTION CLUB team will inform the Creator of the reason and, eventually, the necessary adjustments so that it can be put back online.
4.2 Filters
4.2.1 The User can choose to display campaigns during their navigation, on the campaign listing page, including selecting additional filters and themes, or even searching by keyword.
4.3 Monitoring of the Campaign by the Creator
4.3.1 Once the campaign has been published, the Creator will have access to an exclusive control area, where they can access the status of their campaign at any time, update the news areas and Accountability.
4.3.2 Once a month, when the amounts collected are transferred, the Creator will receive a report of the contributions received that month. The names and emails of each Contributor can be easily accessed through the control panel.
4.4 Transparency It is Accountability
4.4.1 A Transparency is one of the fundamental pillars of the existence of the MONTHLY CONTRIBUTION CLUB. All initiatives must make an extra effort in this regard.
4.4.2 There will be real-time monitoring on each campaign page so that Users know how much money is being raised monthly, from how many Users, date of contribution, and amount contributed.
4.5 Exemption from liability for taxes related to Users’ activities
4.5.1 Ingesto recommends that Users inform themselves about any taxes applicable to the delivery and/or receipt of resources made through the website. Ingesto is not responsible for tax obligations arising from the activities of Users of the website, which are the sole and exclusive responsibility of Users.
5. Systems Payment
5.1 Contribution through Wirecard
5.1.1 Collaboration with financial resources will be done through the Wirecard system (www.wirecard.com.br). The Wirecard system allows the MONTHLY CONTRIBUTION CLUB to display the fundraising status in real time on the campaign page.
5.2 Monthly Payments
5.2.1 THE MONTHLY CONTRIBUTION CLUB uses the Wirecard Subscription service to generate monthly payments for campaigns. Every collaboration on the platform is considered a monthly subscription and will be deducted every month until the subscription is canceled by the Contributor, directly on the Wirecard website or by contacting O Ingesto.
5.3 Receiving the money
5.3.1 The total value of the monthly contributions, deducting the Intake fee (item 6), will be transferred to the Creator's Wirecard account, between the 15th and 25th of the month following the collection. The amount can be withdrawn in full at any time following Wirecard rules. In any case, the form and deadline for reimbursement are stipulated by Wirecard, in accordance with its operating rules, over which Ingesto has no influence.
5.4 Ingesto disclaimer – Services Offered by Wirecard
5.4.1 Ingesto has no control over the service Payment online provided by Wirecard, including those referred to in this Clause 5, as well as by credit card systems, so that it is not responsible for, nor guarantees in any way, payments processed through Wirecard, or using credit cards .
5.4.2 Ingesto will not be able to intervene in the results of the User's relationship with the company responsible for payment management, as it manages its operations independently of Ingesto.
5.4.3 Ingesto cannot guarantee in any way that the services provided by the company responsible for managing payments will operate free of errors, interruptions, malfunctions, delays or other imperfections.
5.4.4 Ingesto will not be responsible for the availability or otherwise of the services provided by the company responsible for managing payments or for the impossibility of using the service.
5.4.5 In case one Payment is not computed for any reason, such as cancellation of the credit card or expiration of its validity, the Contributor will be notified and, if he does not provide new valid data for Payment, his subscription will be canceled and he will be removed from the campaign Subscriber list for the following month.
6. Fee – The Intake fee for the MONTHLY CONTRIBUTION CLUBE platform service
6.1. Ingesto charges 8.5% of Commission about all contributions to campaigns within the MONTHLY CONTRIBUTION CLUB platform.
7. Sponsors – Authorization to Place Brands
7.1. The Creator, when using the MONTHLY CONTRIBUTION CLUBE platform, accepts and recognizes the right of Ingesto and its eventual sponsors to publish their brands in the “Captadores” area. Company Contribution to Campaigns
7.2. The platform allows companies to contribute to campaigns. Just like any Contributor, the image of these companies may be displayed on the Fundraisers tab. Initiatives that already have sponsors
7.3. If Initiative campaign coordinator already has a sponsoring or supporting company, the Creator may use the campaign description area to display the respective image of the legal entity in question, as long as it is previously submitted and approved by Ingesto, with the Creator being fully responsible for the use of these respective images. The images of such companies will only be shown in the pickup area of the Project if there is any collaboration between the company and the campaign through the platform.
8. Registration – Registration Information
8.1. The interested party's registration will only be confirmed when all mandatory registration fields are completed. The User must complete it with accurate, precise and truthful information, and undertakes to update their personal data whenever any changes occur.
8.2 The User must provide a valid email address when registering. User responsibility for registration information
8.2. Ingesto is not responsible for the correction of personal data entered by its Users. Users guarantee and respond, in any case, to the veracity, accuracy and authenticity of the personal data registered. User Identification
8.3. Without prejudice to the clauses above, Ingesto reserves the right to use all valid and possible means to identify its Users, as well as to request additional data and documents that it deems to be relevant in order to verify the personal data provided. User Cancellation due to incorrect data
8.4. If Ingesto decides to check the veracity of a User's registration data and finds that there is incorrect or untrue data among them, or even if the User has acted in bad faith, steals or refuses to send the required documents, Ingesto may block it for the publication of campaigns, or even temporarily suspend or definitively cancel the User's registration, without prejudice to other measures that it deems necessary and appropriate.
8.5. If any of the sanctions mentioned above are applied, campaign publications made by the User on the website will automatically be cancelled, and, for this reason, the User will not receive any type of compensation or reimbursement. Privacy and access password

8.8. Under no circumstances will the assignment, sale, rental or other form of transfer of the account or ownership of Project. The maintenance of more than one registration by the same person will also not be permitted, or the creation of new registrations by people whose original registrations have been canceled due to violations of Ingesto's policies.
