Welcome to Ingesto Platform. Below we present to you ("Visitor") you Terms of Use and Browsing Conditions ("Terms"), a document that sets out the main rules that must be observed by everyone who accesses the website www.Igesto.com.br, its subdomains or uses its tools.
By visiting or using this website it is assumed that you have read and agreed with all of the items below.
A Ingesto is a Portal that mediates the withdrawal of funds (“Contributions”) for designing and developing new products collaboratively, commonly known as Crowdfunding, in English.
For the purposes of this document, the following definitions and descriptions should be considered for better understanding:

Campaign Developer: Registered user who develops and presents a Campaign, sob sua exclusiva responsabilidade, para captação de contribuições para o desenvolvimento de seu projeto ou produto.

1 – Access and functionality restrictions
1.1. This Portal is dedicated to hosting the website Ingesto Platform, whose activity is to intermediate the collection of funds for the development of new products or projects, known as Crowdfunding.
1.2. Visitors and users are not permitted to access the Portal's programming areas, its database or any other set of information that is part of the Portal's activity. Webmastering, whoever does so is subject to Brazilian criminal law and obliged to repair the damage they cause.
1.3. It is also not authorized to carry out or allow reverse engineering, nor translate, decompile, copy, modify, reproduce, rent, sublicense, publish, disclose, transmit, lend, distribute or, in any other way, dispose of the consultation tools of this Portal and its functionalities.
1.4. 7.12. 8.2.2. As campanhas poderão beneficiar terceiros que não o próprio elaborador, ficando a cargo deste repassar o que foi arrecadado ou o resultado da campanha. Caso o beneficiário se recusar a receber o que foi oferecido, os colaboradores não terão qualquer direito sobre o que foi enviado à Ingesto Platform, with the creator remaining the legitimate holder.

Errors or suspected mistakes.

8.10. 9 – Campaign and Payment modalities

9.10. O Ingesto não se responsabiliza pela entrega das recompensas, tampouco por quaisquer custos incorridos pelo Colaborador caso este pretenda se valer de meios legais para ter suas pretensões atendidas junto ao Elaborador.
8.2.2. As campanhas poderão beneficiar terceiros que não o próprio elaborador, ficando a cargo deste repassar o que foi arrecadado ou o resultado da campanha. Caso o beneficiário se recusar a receber o que foi oferecido, os colaboradores não terão qualquer direito sobre o que foi enviado à Ingesto, permanecendo o elaborador como o legítimo detentor.
8.2.3. Em caso de descumprimento pelo Usuário Elaborador de quaisquer das disposições da campanha criada, O Ingesto não será responsável por realizar o que não foi cumprido, especialmente, mas não se limitando a entregar determinado produto ou realizar o serviço prometido. O Usuário Colaborador deverá buscar a satisfação do que foi dado em compromisso pelas vias legais, sem qualquer interferência, responsabilidade ou intermediação do Ingesto.
8.3. Ingesto may change the eligibility criteria at any time. You also have the right to refuse to grant an access account to any person or entity that has failed to comply with the Ingesto Portal Terms or legal document and has had their access account deleted for this reason.
8.4. Ao contribuírem com as campanhas existentes os usuários colaboradores não adquirem qualquer direito à propriedade intelectual dos conteúdos enviados pelos usuários elaboradores, tampouco do produto ou serviço que será produzido ou desenvolvido.
8.5. O usuário está ciente que deverá possuir cadastro em um dos arranjadores de pagamento que o Ingesto aceita em sua plataforma. Assim, deverá ler atentamente aos Termos de Serviço respectivos para que eleja qual utilizará.
8.5.1. Também, está de acordo que ao utilizar essas plataformas poderá haver aplicação de tarifas sobre o montante arrecadado, cujo pagamento está vinculado exclusivamente à movimentação de capital no arranjador escolhido.
8.6. If the creating user offers more than one type of reward, the contributing user can choose the one that best suits him/her at the time of contribution, as long as it meets the minimum value required.
8.7. Ingesto reserves the right not to publish or delete campaigns and content sent by users, at any time, without prior notice and without any right to compensation to anyone, that contain:
Racism or discrimination of any nature;
Bullying, Stalking or any other type of illegal embarrassment or harassment;
Manifests violation of copyright or image rights;
Use of brands, symbols, logos or emblems of third parties;
Instigation or support for the commission of crimes, such as drug trafficking or use, rape, homicide, embezzlement, among others;
Manifests the practice of an act contrary to the law, public order or good customs;
Use of violence, dissemination of hate or any other form of aggression against someone's physical well-being;
Commercial activity similar to Ingesto or that uses the platform to raise resources through third-party advertising instead of regular interaction in the environment;
Errors or suspected mistakes.
8.8. Visitors will be able to use the 'Contact Us' channel whenever they see or verify inappropriate content on the website.
8.8.1. The report will be confidential and will preserve the visitor's identity.
8.9. Content sent by users and published on the Ingesto Portal should not be interpreted as Ingesto's opinion, nor a declaration of agreement with what was published. Users are entirely responsible for the content they submit to the Portal.
8.10. Os usuários autorizam O Ingesto a divulgar amplamente as campanhas em execução e aqueles que promoveram as colaborações nos mais diversos meios de comunicação e mídias, de modo a estimular maior participação nas atividades por outras pessoas e aumentar a chance de sucesso da campanha, sem a exigência de remuneração ou contraprestação qualquer resultante dessa disseminação.

9 – Campaign and Payment modalities
9.1. “All or Nothing”: The “All or Nothing” campaign is defined for a period of 1 to 60 days in which the creating user establishes a minimum amount for collection and, if it is not reached at the end, the contributions will be returned to the users related.
9.1.1. Se a campanha atingir ou superar a meta estabelecida, o valor total arrecadado será transferido para a conta do usuário elaborador da campanha, exceto por 10%, valor devido à Ingesto pelos serviços do Portal Ingesto que serão automaticamente retidos no momento do envio, além de eventuais tributos incidentes e às tarifas dos arranjadores de pagamento e instituições financeiras envolvidas.
9.1.2. Se a campanha não atingir a meta estabelecida, haverá devolução das contribuições à conta Paypal, Tripe, Wirecard ou cartão de crédito do usuário colaborador em até 30 dias após encerramento da campanha, podendo ser realocada em outra campanha em andamento ou solicitar o estorno, sempre que requisitado em até 120 dias do efetivo pagamento, caso utilize PayPal, ou 170 caso utilize Paypal, Tripe, Wirecard, da seguinte forma:

9.2. “Flexible”: The “Flexible” campaign is defined for a period of 1 to 60 days in which the creating user establishes a minimum amount for fundraising and, if it is not reached at the end, will take advantage of the amounts that were gathered for your campaign.
9.2.1. Se a campanha atingir ou superar a meta estabelecida, o valor total arrecadado será transferido para a conta do usuário elaborador da campanha, exceto por 10%, valor devido à Ingesto pelos serviços do Portal Ingesto que serão automaticamente retidos no momento do envio, além de eventuais tributos incidentes e às tarifas dos arranjadores de pagamento e instituições financeiras envolvidas;
9.2.2. Se a campanha não atingir a meta estabelecida, o valor total arrecadado será transferido para a conta do usuário elaborador da campanha, exceto por 10%, valor devido à Ingesto pelos serviços do Portal Ingesto que serão automaticamente retidos no momento do envio, além de eventuais tributos incidentes e às tarifas dos arranjadores de pagamento e instituições financeiras envolvidas.
9.3. “Ingesto Initial Contribution”: Ingesto, out of mere liberality, and for believing in the Campaigns created on the Portal, undertakes to make the first contribution to every new Campaign launched on the Portal in the amount of R$10.00 (ten reais).
9.3.1. Este valor será visível desde o primeiro momento, porém só terá seu pagamento efetivado se a Campanha receber outra (s) contribuição (ões) que some (m) um mínimo de R$500,00 (quinhentos reais). Desta forma, a Contribuição Inicial Ingesto não será efetivada e/ou devida caso o valor final das contribuições adicionais não atinja o valor mínimo mencionado. O Ingesto poderá optar por fazer contribuições iniciais maiores e o pagamento efetivo destes valores estará sempre condicionado a uma arrecadação da campanha 50 vezes maior do que o prêmio concedido.
9.4. Ingesto reserves the right to only include the Campaign in its list of Campaigns available for search and location on the Platform after the second contribution received has been made.
9.5. Todas as transações e operações utilizarão o Real Brasileiro como câmbio (BRL). O usuário elaborador da campanha é o responsável pelo pagamento de todos os impostos e taxas de serviços relacionados ao uso do Portal Ingesto, podendo ser descontados automaticamente pelo Ingesto, para evitar sonegação fiscal.
9.6. Encerrado o período de apuração da campanha alcançando o objetivo de arrecadação (se existir), independentemente da sua espécie, O Ingesto transferirá os valores arrecadados ao usuário elaborador no período de até 14 dias úteis após o recebimento pelos arranjadores de pagamento. Os valores recebidos pelo usuário elaborador já estarão reduzidos dos tributos e tarifas incidentes.
9.7. The contributing user is solely responsible for monitoring the evolution of the campaign, through information provided by its developer and, alternatively, through details sent by Ingesto. Therefore, you are aware that Ingesto has no obligation to send statuses about campaigns.
9.7.1. It is the sole responsibility of the contributing user to find out whether the campaign was successful or not, and whether credit was returned to their account, so that they can reinvest the contribution or request a refund. The Ingesto Portal will spare no effort to keep the contributing user updated on the success or failure of the campaign supported by them, which will not represent any responsibility on the part of Ingesto, to which its users expressly agree.
9.8. Also, Ingesto does not have any responsibility, directly or indirectly, for the information provided by the campaign creator, whether in relation to its development, rewards offered, execution time or related to any other type of detail.
9.9. O Ingesto não oferece nenhuma garantia em relação às contribuições realizadas pelos arranjadores de pagamento e nem responde por falhas no cartão de crédito ou transferências bancárias, já que as plataformas de pagamentos são independentes do Portal Ingesto.
9.10. The amounts refunded to the user's account that are not refunded or given in support of another active campaign within 1 year of their return will be automatically retained by Ingesto and allocated to Ingesto's Internal or Bounty campaign or in the absence of a Internal/Bounty campaign, the value will go to the campaign that leads the popularity ranking, that is, that has the highest activity rate.

Campaign Creator Commitment
Ingesto, a legal entity under private law, with headquarters in the city of São Paulo, State of São Paulo, to SEPS Qd 710/910, Cj. D. Lj 28, Brasília/DF, CEP.: 70.390-108, registered with CNPJ under no. 18.171.211/0001-52, hereinafter referred to as Ingesto, exposes the CREATOR USER, here considered to be the one duly authenticated on the website www. Ingesto.com.br, by this TERM OF COMMITMENT the conditions for creating crowdfunding campaigns on the Ingesto website.
The Ingesto website is an environment based on trust, both by USERS CREATING campaigns and USERS CONTRIBUTORS. Therefore, if you do not agree with these provisions, do not proceed with creating your campaign.
1. This TERMS consolidates the good faith commitment of the CREATOR USER with Ingesto and the CONTRIBUTOR USERS of its platform, in addition to the Terms of Use of the Ingesto website, the knowledge and agreement of which by the CREATOR USER are mandatory, with the following conditions:
2. Ingesto undertakes to:
2.1. Disponibilizar espaço em sua plataforma para a divulgação e visibilidade das campanhas criadas pelos USUÁRIOS CRIADORES, de forma a permitir que alcancem a arrecadação de recursos conforme a modalidade escolhida, “Tudo ou Nada”, ou “Flexível”, mediante o uso de um dos instituidores de pagamento disponibilizados.
2.2. Keep the amounts donated by CONTRIBUTOR USERS and, depending on the outcome of the campaign, transfer the amounts to the user who created it or return the amount to the participants, according to the characteristics of the campaign;
2.3. Make your efforts to allow only suitable and lawful campaigns in your environment. Therefore, you have the right not to defer, publish, remove or terminate any campaign that contradicts the legislation in force in Brazil or the Terms of Use of the Portal, without any right to compensation to the CREATOR USER and returning the amounts donated by the CONTRIBUTING USERS;
2.4. Notify CONTRIBUTOR USERS of the results of the campaigns created and requesting action, if applicable.
3. THE CREATOR USER undertakes to:
3.1. Develop your campaign based on the principles of good faith, veracity and legality, fully complying with the Terms of Use of the Ingesto Portal, under penalty of taking the measures indicated in 2.3;
3.2. Execute the reward promises indicated in the description of the campaign created in its strict terms, bearing the costs of shipping, freight, transport, travel and other charges that are necessary to satisfy the indicated promise, under penalty of suffering legal measures brought by the CONTRIBUTING USERS;
3.3. Assume all legal demands that are motivated by its own action or omission, and must request the exclusion of Ingesto from the dispute and compensate it for expenses arising from legal fees and losses and damages it causes, in accordance with the law.
3.4. Reconhecer o direito do Ingesto em reter os valores atinentes à prestação de serviços para organização, divulgação e hospedagem de sua campanha no momento da transmissão dos valores arrecadados, conforme a modalidade escolhida.
3.5. Previously authorize the possibility of Ingesto providing its registration data to CONTRIBUTOR USERS whenever there is a breach of the promise of reward or a harmful event against them, in addition to recognizing the legitimacy of this act by agreeing to this TERM OF COMMITMENT.
3.6. A não ingressar com medidas judiciais contra o Ingesto ou os USUÁRIOS CONTRIBUIDORES caso a campanha não obtiver o êxito esperado, independentemente do motivo, causa ou razão, especialmente por atos praticados pelos USUÁRIOS CONTRIBUIDORES que frustrem doação já realizada ou, de alguma forma, se arrependam.
3.7. Caso haja o cancelamento ou a contestação de pagamento de alguma contribuição realizada na campanha, O Ingesto fica autorizada a deduzir, a qualquer momento, o valor da contribuição cancelada ou contestada, da arrecadação total da campanha.

O Ingesto se reserva o direito de, na hipótese do não pagamento dos valores acima mencionado, utilizar todos os meios de cobranças aceitos pela legislação brasileira e, inclusive, comunicar a inadimplência do Participante aos órgãos e entidades de proteção ao crédito.
4. Ingesto is not responsible for:
4.1. Pelas medidas tomadas pelos USUÁRIOS CONTRIBUIDORES que visem frustrar a doação ora conferida, independentemente de seus motivos, causas ou razões;
4.2. Due to the unavailability of the Portal, however, it endeavors to ensure that it remains as operational as possible, as already described in the Terms of Use of the Ingesto website;
4.3. For the frustrations that the CREATOR USER may suffer as a result of the outcome of the campaign they promoted. Ingesto does not have the legitimacy to interfere or control what CONTRIBUTOR USERS will perform.
4.4. Pelos atos praticados pelo instituidor de pagamento escolhido, tal qual o valor das tarifas e descontos aplicados em virtude da custódia, armazenamento, retirada, conversão do montante ou ato diverso que implique em pagamento pelo serviço contratado, nas formas da lei e dos Termos de Serviço do instituidor correspondente.
5. This TERM OF COMMITMENT is governed by the laws of the Federative Republic of Brazil and by the International Treaties and Conventions to which Brazil is a signatory, and must be interpreted in the Portuguese language, with the Court of the District of the Capital of the State of São Paulo being elected, with express waiver of any other, however privileged it may be or may become, to resolve any doubt, pending issue or dispute arising from this contract.
Contribution Club Terms of Use
Welcome to the Ingesto Portal. Below we present to you (user) the Terms of Use and Browsing Conditions, a document that lists the main rules that must be observed by everyone who accesses the MONTHLY CONTRIBUTION CLUB or uses its tools.
By visiting or using this website it is assumed that you have read and agreed to all the terms below.
1. Acceptance of the Term
1.1. By using Ingesto's recurring platform in any way, including, but not limited to, visiting or browsing the website and publishing or contributing to recurring campaigns, you agree to these Terms of Use, which include the Privacy Policy, as well as the rules operational and procedures that may be published on the website from time to time.
1.2. Recurring campaign services are only available to people who have the legal capacity to contract them. Children under 18 (eighteen) years of age, or any person who does not have full civil capacity, cannot use them.
2. Purpose of the Monthly Contribution Club
2.1 Objectives and tools
2.1.1 The platform's objective, through its website, is to provide Users with a space to promote initiatives of any topic or scope, which cause some type of positive impact and require monthly financial collection for their activities. The MONTHLY CONTRIBUTION CLUB therefore makes it easier for Users to get to know each other, serving as a meeting point between people who need resources to make their initiatives viable, hereinafter referred to as “Creators”, and people who are interested in collaborating for the financing, hereinafter referred to as “Contributors”.
2.1.2 As a means of achieving its objective, the MONTHLY CONTRIBUTION CLUB offers tools that make it easier for Creators to make their initiatives viable through the collection of financial resources offered by Contributors in the form of a monthly subscription.
3. How It Works – Basic Rules
3.1 Submitting a proposal and publishing a campaign
3.1.1 A publicação de uma campanha no CLUBE DE CONTRIBUIÇÃO MENSAL é e deve ser feita através dos passos descritos no item 4.1, quando os Criadores devem responder um formulário no qual será possível descrever a iniciativa e fazer a proposta de campanha.
3.1.2 Sometimes it will be necessary to make adjustments to the initial club so that it suits the purpose of the platform. Other times, the club will not fit into the philosophy of the platform and the MONTHLY CONTRIBUTION CLUB team will have the autonomy to refuse such clubs.
3.1.3 Once published, the MONTHLY CONTRIBUTION CLUB will have its own page on the platform, through which Contributors will be able to contribute monthly subscription amounts starting at R$10.
3.1.4 The responsibility for the dissemination and fundraising of Contributors lies exclusively with the Creator, with the MONTHLY CONTRIBUTION CLUB team only facilitating this process, so that it cannot be held responsible for the success of the fundraising.
3.2 Contribuição e pagamento
3.2.1 Para colaborar com uma campanha, o Usuário deverá (i) entrar na página da campanha em questão; (ii) clicar no botão de chamada para apoio; (iii) entrar seus dados de login ou preencher o formulário de cadastro (iv) ler e aceitar os Termos de Uso do CLUBE DE CONTRIBUIÇÃO MENSAL; (v) colocar seus dados de pagamento, que serão passados diretamente para a operadora Wirecard, conforme descrito no item 5.1.
3.2.2 Toda colaboração feita para uma campanha na plataforma do CLUBE DE CONTRIBUIÇÃO MENSAL é uma assinatura mensal. Ao fazer uma contribuição, o Contribuidor se declara ciente de que aquele mesmo valor será descontado de seu cartão de crédito todos os meses, até que seja feito o cancelamento da assinatura pelo próprio Contribuidor ou por algum outro motivo externo, como falta de pagamento, por exemplo.
3.2.3 O primeiro pagamento é feito na hora da colaboração e a partir daí todos os pagamentos serão descontados no mesmo dia, nos meses seguintes.
3.2.4 A partir do primeiro pagamento, o Contribuidor entra para a lista de Assinantes da campanha. Caso a assinatura seja cancelada por qualquer motivo, o Usuário deixa de fazer parte da lista de Assinantes.
3.2.5 The Contributor may modify the value of their subscription or cancel it at any time they deem appropriate.
3.2.6 The Creator will have access to the complete list of collaborations and their respective Contributors, including their registration data.
3.2.7 Todas as transações são gerenciadas pelo serviço de pagamento Paypal (paypal.com), ou Tripe (tripe.com), inclusive a parte de segurança dos dados.
3.3 Goals and Rewards
3.3.1 The continuous fundraising system offered by the MONTHLY CONTRIBUTION CLUB establishes that goals must be designated by the Creators as a way of communicating to all Users the destination of the resources, as well as motivating collaboration and creating significant milestones throughout the process.
3.3.2. Goals are monthly financial amounts that the campaign wants to achieve for specific purposes. Each goal is made up of 03 (three) basic components: Financial value: the monthly fundraising amount you want to achieve; Delivery proposal: what will be done with the money if that amount is collected monthly; Reward proposal: a reward to be delivered to contributors.
3.3.3. Rewards are always linked to goals and are based on the concept of celebration. Unlike crowdfunding platforms with specific collaborations, in which a reward is delivered for each collaboration, in the MONTHLY CONTRIBUTION CLUB rewards are delivered whenever a goal is reached, as a way of marking this important moment.
3.3.4 Rewards can be products, services, experiences (participation in courses, parties, workshops, etc.) or even symbolic (thanks, recognition, name in credits, etc.).
3.3.5 It is not permitted to offer financial rewards as an incentive for collaborations, including, but not limited to: offering equity participation in for-profit entities or any type of security, as well as the promotion of raffles and sweepstakes. It is clear to Contributors, therefore, that financial contributions cannot be made for the purpose of financial return.
3.4 Benefits
3.4.1 As iniciativas são encorajadas a oferecer benefícios aos seus Contribuidores, como o direito de voto em alguma questão específica, o acesso a informações internas ou a participação em algum tipo de evento, por exemplo. Esta é uma forma de incentivar as colaborações dando protagonismo ao Contribuidor dentro da iniciativa, transformando-o em um agente ativo dentro do processo. Esses benefícios nada têm a ver com as recompensas, explicadas no item 3.2, que marcam a conquista de uma meta financeira específica.
3.5 The Role of Intake and the Creator's Sole Responsibility for Implementation
3.5.1 The MONTHLY CONTRIBUTION CLUBE platform only offers the structure of its website and does not participate in the creation of the initiatives published on it, nor in their implementation. The campaigns run, the execution of objectives and the delivery of promised rewards are the exclusive responsibility of the Creators. Ingesto is not responsible, therefore, for the way in which resources are used, for the achievement of objectives and for the delivery of such rewards, for their veracity or their quality.
3.5.2. Eventually Ingesto may publish its own campaign. In this case, said information will be expressly published on your website and, solely and exclusively in this case, you will assume the responsibilities of a Creator.
3.6 Possibility of post-moderation
3.6.1 The relationship between Creators and Contributors occurs directly, without intervention from Ingesto, which only provides space on its website. Ingesto does not mediate business through the MONTHLY CONTRIBUTION CLUB platform. Ingesto, although it does not assume responsibility for the content generated by its Users, nor has any obligation to monitor its content, reserves the right to discretionally and at its sole discretion remove any content considered inappropriate from the website.
3.7 The platform’s philosophy
3.7.1 THE MONTHLY CONTRIBUTION CLUB, like O Ingesto, exists to help bring to life initiatives that generate collective impact. For a campaign to be accepted on the platform, it must articulate what type of impact it generates and how the resources mobilized through the MONTHLY CONTRIBUTION CLUB will help expand this impact. All proposals will be analyzed by the MONTHLY CONTRIBUTION CLUB team, who will check whether they are aligned with the philosophy of the platform and Ingesto.
3.7.2 Any campaigns with illegal, immoral, obscene, racist, offensive content or content that is in violation of morality and good customs or current legislation, or that fails to comply with any condition established in these Terms, are not permitted and may be removed from the air. Partisan political campaigns or campaigns with a religious promotion theme will also not be accepted.
4. The Campaigns – Details
4.1 Campaign publication
4.1.1 Para publicar uma iniciativa no website e se tornar um Criador, o Usuário deverá clicar no botão de lançar clube de contribuição, passando pelas seguintes etapas: (i) cadastro completo; (ii) leitura na íntegra e com atenção deste Termos de Uso, Política de Privacidade e demais regras de utilização do CLUBE DE CONTRIBUIÇÃO MENSAL; (iii) leitura atenta da apresentação que mostra os detalhes sobre a dinâmica; (iv) descrição da iniciativa por meio de preenchimento do formulário online; (v) detalhamento das 03 (três) primeiras metas e suas recompensas associadas; (vi) submissão da campanha e publicação pelo na plataforma.
4.1.2 If the proposal complies with the conditions established in this term, after the process described in item 3.1 and its sub-items, the Creator will receive a campaign page on the platform, which will be available online to receive contributions from Contributors.

4.2 Filters
4.2.1 The User can choose to display campaigns during their navigation, on the campaign listing page, including selecting additional filters and themes, or even searching by keyword.
4.3 Monitoring of the Campaign by the Creator

5.3 Receiving the money
5.3.1 The total value of the monthly contributions, deducting the Intake fee (item 6), will be transferred to the Creator's Wirecard account, between the 15th and 25th of the month following the collection. 11. System or Database Breach

12. Sanctions
