PRIVATE VOLUNTARY SERVICE CONTRACT INSTRUMENT
Below is the contract that establishes the terms of the relationship between the parties in the execution of the services described in this document.

By this private instrument, signing between the PARTIES, INGESTION – Institute FOR MANAGEMENT OF Third sector, with an administrative office located in SEPS Qd. 710/910, Conjunto D, Loja 28, CEP: 70.390-108, Brasília/DF, CNPJ 18.171.211/0001-52, in this act represented by Mrs. Mary Barbosa dos Santos Ferreira, Brazilian, married, Consultant, Identity No. (MG-4.378.922), CPF No. (851.591.406-97), resident and domiciled at Rua Angaturama, nº 520, São Paulo neighborhood, CEP: 31.910-220 , Belo Horizonte/MG), contact email address: contato@ingesto.org.br, President of Institute, hereinafter referred to simply as INGESTION, and on the other side the USER who must accept this instrument with all its legal implications, hereinafter referred to simply as VOLUNTARY, they have the following just and right among themselves:
A) CONSIDERING that the INGESTION is an institution with experience in the Services provision in the area of fundraising, fundraising via collective financing, crowdfunding, Social Marketing, ambiental, esportivo, de patrocínios culturais, turísticos, isenção fiscal através de IR, ICMS, ISS, dentre outros, apta a prestar serviços de apoio administrativo na captação de recursos para Organizações do Third sector.
B) WHEREAS that the VOLUNTARY is a natural person who is available to act as a volunteer with the INGESTION, which qualifies you for the contractualization resulting from this contract.
C) CONSIDERING that both, INGESTION It is VOLUNTARY, they want a Partnership lasting, WAKE UP, among themselves, the present is fair and right Contract of Services provision Voluntary, which will be governed by the following clauses and the conditions described in this instrument.
OF Object
Clause 1 – O VOLUNTARY will provide services related to its area of training, as well as work to achieve the objectives established by the INGESTION in all demands that are passed on to you by your collaborator and that are within their area of professional or educational knowledge, or even in those areas in which the VOLUNTARY demonstrate interest in working, and which are areas of activity of the INGESTION. Dentre as atribuições que podem lhe ser solicitado através de suas horas de trabalho estão aquelas estabelecidas pelo INGESTION.
OBLIGATIONS
Clause 2 – A INGESTO will present to the VOLUNTARY the necessary conditions for the development of the activities assigned to it.
Clause 3 – A INGESTION is responsible for informing the VOLUNTARY whether, for reasons of force majeure, it will release you from its services and whether this contract will be terminated through official communication at least (30) days in advance.
Clause 4 – If VOLUNTARY necessite, por motivo de força maior, alterar os dias e horários da prestação de seus serviços, bem como a rescisão deste contrato, deverá informar a INGESTION through an official communication at least in advance from (30) days.
Clause 5 – O VOLUNTARY declara que é detentor de todas as condições necessárias ao desempenho dos serviços a que se compromete e que tem ciência de que, no caso de acarretar danos a terceiros, sejam decorrentes de dolo ou culpa, poderá ficar sujeito a arcar com os consequentes prejuízos.
Cláusula 6ª – O VOLUNTARY declara, espontaneamente, estar ciente e de acordo com os termos da Lei Federal nº 9. 608 de 18/02/98, que dispõe sobre o serviço VOLUNTARY, cujo conteúdo está disponível no referido link.
REMUNERATION
Clause 5 – The services provided by VOLUNTARY serão gratuitos, sendo de sua livre e espontânea vontade a execução deles e toda Services provision descritos neste contrato, bem como aqueles razoavelmente solicitados pelo INGESTION e de seus colaboradores e que concordou em realizá-los.
Clause 6 – Expenses for work carried out by the VOLUNTARY for expenses authorized in writing by the INGESTION (reimbursement of a volunteer for out-of-pocket expenses incurred in the course of their Volunteering).
TERMINATION
Clause 7 – This contract may be terminated at any time, by Initiative from either party, which will not result in any type of compensation to the VOLUNTARY or to INGESTION.
Clause 8 – A INGESTO criteria, any failure to comply with the expectations described below may result in the termination of this contract:
8.1. Motivations:
8.1.1. Treat all information passed on in a non-confidential manner INGESTION or that you become aware of through this contract;
8.1.2. All activities carried out during the Volunteering are associated with the INGESTION and must be mentioned and credited to the INGESTION;
8.1.3. O VOLUNTARY undertakes to provide the INGESTION copy of all documents developed, created or produced by you;
8.1.4. O VOLUNTARY agree not to post photos, videos, texts or any type of communication on the internet related to the INGESTION without prior written authorization.
TERM
Clause 9 – This contract lasts for 12 months and can be extended for an equal period at the discretion of the parties.
VOLUNTEER PERMITS
Clause 10 – O VOLUNTARY a título gratuito e em caráter definitivo, irrevogável, irretratável e por prazo indeterminado autoriza o uso de suas informações e suas logomarcas/imagens a serem utilizadas pelo INGESTION at the Portfolio on its website or in its printed material, in classes and lectures, as well as for the dissemination of this information through INGESTION em e-mails e reuniões de trabalho, com objetivos de angariar financiadores, patrocinadores, doadores e apoiadores, bem como para o próprio marketing da INGESTION, in search of other VOLUNTEERS ou outros tipos de atividades.
Clause 11 – O VOLUNTARY undertakes to disclose, if any, in its means of communication, such as: websites, blogs, websites, Facebook, Instagram, WhatsApp, Twitter, Linkedin and other social media platforms, the INGESTION as Mentor and Advisor according to the content described in this contract.
COMMITMENT, SECRECY AND CONFIDENTIALITY
Clause 12 – Todas as informações técnicas, logins, senhas, acessos de plataformas de qualquer natureza, obtidas através da relação entre o INGESTION and the VOLUNTARY, and related to Object do presente contrato, relativo às especificações, funcionamento, organização, desempenho ou qualquer conteúdo que envolva o INGESTION serão tidas como CONFIDENTIAL AND CONFIDENTIAL.
Clause 13 – For the purposes of this term, any and all information, whether patented or not, of a technical, operational, commercial, legal, Know-how, inventions, processes, formulas and designs, patentable or not, production systems, logistics and layouts, business plans (business plans), accounting methods, techniques and accumulated experiences, documents, contracts, papers, studies, opinions and research to which the VOLUNTARY have access:
13.1 – By any physical means (e.g. express documents, manuscripts, facsimile, electronic messages (e-mail, sms, msn), photographs etc.;
13.2 – In any form, recorded on electronic media (pendrive, tapes, CDs, DVDs, floppy disks, via the internet, intranet, corporate network, etc.);
13.3 – Orally.
Clause 14 – O VOLUNTARY undertakes to maintain confidentiality by not using such confidential information for its own benefit or that of others.
Clause 15 – Confidential information entrusted to the VOLUNTARY may only be opened to third parties with the prior written consent of the INGESTION, or in case of judicial determination, in which case the VOLUNTARY must immediately inform, in writing, the INGESTION so that it seeks to obstruct and remove the obligation to reveal the information.
Clause 16 – Confidential information does not include:
16.1 – Now available to the general public through no fault of the employee;
16.2 – That were already known to the employee before signing this contract and that were not acquired directly or indirectly from the INGESTION;
16.3 – Which are no longer treated as confidential by INGESTION.
Clause 17 – All confidentiality and secrecy information provided for in this Clause will be valid throughout the term of this instrument, for as long as this contract lasts and, also, for a minimum period of 02 (two) years after the termination of this contract.
LEGAL BINDING
Clause 18 – This contract, due to its Object and nature, does not generate for the VOLUNTARY any relationship of a labor or social security nature with regard to professionals and representatives of the INGESTION, as well as not having the INGESTION, any relationship of a labor or social security nature regarding the VOLUNTARY or possible representatives.
Clause 19 – If necessary, the INGESTION assumes, in the activities described in the caput desse contrato todas as responsabilidades advindas das contratações de terceiros, de plataforma técnicas ou aplicativos para a realização e execução do presente contrato, nas responsabilidades as quais lhe cabe, isentando o VOLUNTARY any joint and several liability.
THE PLACE AND TIME OF PROVISION OF SERVICES
Clause 20 – The mandatory payments described in the caput of this contract and its sections will be provided within the business hours of the INGESTION, of 9 (nine) hours of the morning to 17 (seventeen) afternoon hours from Monday to Friday, preferably with a minimum weekly workload of 10 hours, on the premises of the INGESTION or in establishments of the VOLUNTARY as necessary, and can also be carried out via telephone, e-mail, Skype, WhatsApp, or other communication platform, respecting the aforementioned business hours or, due to the interest or availability of the VOLUNTARY, run them at whatever time is most convenient for you.
GENERAL CONDITIONS
Clause 21 – O VOLUNTARY declara reconhecer que a prestação dos serviços descritos nesse documento não gera vínculo empregatício, nem obrigações de natureza trabalhista, previdenciária ou afim; que inexiste controle de frequência ou exigência de aviso prévio formal no caso de descontinuidade da relação Object deste Termo 1 .
Clause 22 – Este contrato terá validade jurídica a partir do reconhecimento por parte do VOLUNTARY através de aceite do formulário que acompanha esse contrato.
Clause 23 – Hereby CONTRACT, O VOLUNTARY grants the INGESTION e seus agentes autorizados, fornecedores, executivos, diretores, funcionários, licenciados, afiliados, sucessores, colaboradores diretos ou indiretos o direito e licença não exclusivo, irrevogável, perpétuo e mundial de usar, reproduzir, exibir, executar, editar, criar trabalhos derivados e distribuir, no todo ou em parte, qualquer material, fotografias, gravações, textos produzidos, criados ou desenvolvidos pelo mesmo, bem como sobre seu trabalho VOLUNTARY realizado durante o atividades patrocinadas pela INGESTION , for any purpose, in any form or media now known or hereafter developed.
ADDITIVE TERMS
Clause 24 – This contract may be amended, modified, deleted and included any Clause, word or text at any time at the full discretion and interest of the INGESTION. Being the responsibility of the VOLUNTARY, periodicamente, verificar o conteúdo do presente contrato objetivando atentar-se as exigências contratuais, bem como aos seus deveres e direitos.
FROM THE FORUM
Clause 25 – To the PARTIES elect the Forum of (Brasilia DF), as the sole and competent person to resolve any claims arising from this contract, waiving any other, however privileged it may be, or may become.
And, because they are together and hired, the VOLUNTARY signs and endorses this instrument presenting its acceptance.
