Who are the 10 Individuals who financed Rouanet the most in 2021 and what do they do?

The latest changes to the old Rouanet Law – Culture Incentive Law – are generating concerns in the artistic area. Different from what was expected, which is to expand Investments and create recovery mechanisms for the cultural sector, the Federal Government's new measures bring restrictions, exclusions of content and limitations in the decision-making process.

See below the main changes published yesterday, July 27, 2021, in the Official Gazette:

1. Weakening of the CNIC

From now on the Commission National Culture Incentive ceases to be a deliberative body and becomes an appellate body that no longer deliberates.

2. Inclusion of Sacred Art

In practice, this already happened and Sacred Art already uses the resources of the Law, but the Decree imposes the inclusion of representatives in the CNIC. The measure is an old request from the evangelical bench to use such resources to restore religious temples with resources from the law.

3. More powers for the president of the CNIC

With the advent of the new law, the president of the CNIC will be able to veto projects unilaterally without the need to consult the other members of the CNIC Commission. Today the decisions are made by André Porciuncula Alay Esteves, captain of the Bahia PM.

4. Performing Arts is no longer included

Despite the admissibility of the projects being presumed, the term “Performing Arts” was eliminated. Fine arts and Sacred Art took their place.

5. Internal regulations of the CNIC for the Minister

From now on, the CNIC's internal regulations will no longer be deliberated internally. On the contrary, the Special Secretary for Culture and the Ministry of Tourism will be responsible.

6. Creation of list of relevant institutions

The Special Secretariat for Culture and the Ministry of Tourism will be able to say which institutions are relevant or not relevant. Which unilaterally may make it possible or unfeasible to release resources to a given institution.

7. Projects with changed annual plans

Projects that have Scope Annual coverage is only permitted for relevant institutions (item 6) and public museums, material and intangible heritage and cultural training actions.

List Characteristics

From the list of Individuals who financed the most Rouanet Law in 2021 there is a predominance of the male gender, 8 men against 2 women, and these two women are related, Jane and Jadna, perhaps they are sisters.

It is important to note that from this list, 8 financiers declared their domicile in São Paulo and 2 in the State of Rio Grande do Sul, coincidentally to Jadna and Jane.

In the list of SALICT in 2021 There are also some names of Individuals, but they use CNPJs of legal entities in the register. I couldn't understand why this feature was on the list. In any case, I avoided including in this list the CNPJs Funders and I am active exclusively in the largest donors of the exercise Individuals who present in the SALIC registration through CPF.

Guidelines for Fundraisers

If you have submitted or are in the process of submitting a Project with the Tax Exemption Legislation, more specifically with the Rouanet Law, it is essential to be aware that the Fundraising process is difficult by nature, as there is much more demand than supply.

So, if you want to achieve a minimum of success in your fundraising process, pay attention to the details below:

  • Meet your potential financier. There is no point in taking the financier's phone data and starting to call, forward emails or messages to the company or individual. In-depth knowledge of the financier's relationships, tastes, hobbies, activities, leisure activities, friends, social networks, etc. is essential. This all aims to make your capture more assertive.
  • Know your Project deeply and be able to convince any financier about the importance and relevance of it. If you are unable to do this, it will be difficult for you to be successful in your fundraising.
  • As the Tax Exemption legislation and all its content are public, anyone has access to the names of financiers and also to telephone data, emails and addresses. Therefore, most companies created a banker, aiming, in the worst case scenario, for their funding to go nowhere. Therefore, it is common for many fundraisers to spend weeks, months and even years raising funds without ever receiving a financial contribution. The excuses are the most interesting possible: – you're having lunch, – you're traveling, – you're not in the room, – you're not coming back today, you'll only be back tomorrow afternoon, – you're not answering, – you're traveling, – your emails did not arrive, – sends again, – information is missing, – we are not interested, etc., etc., etc. When you see it's been weeks, months. So let me be clear, it is not enough to know the name, telephone number, emails, addresses and social networks of your funder, you need to create a network and to do this you need to access the networks of friends and colleagues of your potential funder.
  • Well, lastly, another thing that you as a fundraiser will find a lot of. The Legal Entities of Profit real, those that are able to provide resources via the Rouanet Law, have strategies to finance their own projects through Organizations of the Civil society – CSOs, directly or indirectly linked to the company. That's why you see that most large companies have their own Institution, Foundation Roberto Marinho, Foundation Bradesco, Foundation BB, Foundation Itaú Social and so on. Thus, it ends up that the resources, which are actually not few, end up being directed to those who need them least, the large companies.
