GUIDELINES FOR CAMPAIGN CREATORS<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t
\n\t\t\t\t\t\t\t\t\t

Ingesto, a legal entity governed by private law, with headquarters in Bras\u00edlia, Federal District, to SEPS Qd 710\/910, Cj. D. Lj 28, Bras\u00edlia\/DF, CEP.: 70.390-108, registered with the CNPJ under no. 18.171.211\/0001-52, hereinafter referred to as Ingesto, exposes the CREATOR USER, here considered to be the one duly authenticated on the website www.ingesto.org.br<\/a>, by this TERM OF COMMITMENT the conditions for creating Crowdfunding campaigns on the Ingesto website.<\/strong><\/p>

The Ingesto website is an environment based on trust, both for CREATOR USERS<\/strong> of Campaigns | Projects | Proposals<\/strong> as for hair COLLABORATOR USERS<\/strong>. Therefore, if you do not agree with these provisions, do not proceed with creating your campaign.<\/p>

1.<\/strong> This one TERM<\/strong> consolidates the good faith commitment of the CREATOR USER<\/strong> as Ingesto<\/strong> and the COLLABORATOR USERS<\/strong> of its platform, in addition to the website's Terms of Use Ingesto<\/strong>, whose knowledge and agreement by the CREATOR USER<\/strong> are mandatory, with the following conditions:<\/p>

2. Ingesto undertakes to:<\/strong><\/p>

2.1.<\/strong> Provide space on your platform for the dissemination and visibility of Campaigns | Projects | Proposals<\/strong> created by CREATOR USERS<\/strong>, in order to allow them to raise funds according to the chosen modality, \u201cTotal or Nothing<\/strong>\u201d, or "Flexible"<\/strong>, mediante o uso de um dos instituidores de pagamento disponibilizados.<\/p>

2.2.<\/strong> Safeguard the values donated by COLLABORATOR USERS<\/strong>\u00a0and, depending on the outcome of the campaign, transfer the amounts to the user who created it or return the amount to the participants, according to the characteristics of the campaign;<\/p>

2.3.<\/strong> Make your efforts to allow only suitable and lawful campaigns in your environment. Therefore, you have the right not to defer, publish, remove or terminate any campaign that contradicts the legislation in force in Brazil or the Terms of Use of the Portal, without any right to compensation to the CREATOR USER<\/strong> and returning the amounts donated by USERS<\/strong> COLLABORATORS<\/strong>;<\/p>

2.4.<\/strong> Communicate the COLLABORATOR USERS <\/strong>of the outcomes of the campaigns created and requesting action, if applicable.<\/p>

3. THE CREATOR USER undertakes to:<\/strong><\/p>

3.1.<\/strong> Develop your campaign based on the principles of good faith, veracity and legality,<\/strong> fully complying with the Terms of Use of the Ingesto Portal, under penalty of taking the measures indicated in 2.3;<\/p>

3.2.<\/strong> Execute the reward promises indicated in the description of the campaign created in its strict terms, bearing the costs of shipping, freight, transport, travel and other charges that are necessary to satisfy the indicated promise, under penalty of suffering legal measures brought by the USERS<\/strong> COLLABORATORS<\/strong>;<\/p>

3.3.<\/strong> Assume all legal demands that are motivated by its own action or omission, and must request the exclusion of Ingesto from the dispute and compensate it for expenses arising from legal fees and losses and damages it causes, in accordance with the law.<\/p>

3.4.<\/strong> Reconhecer o direito do Ingesto em reter os valores atinentes \u00e0 presta\u00e7\u00e3o de servi\u00e7os para organiza\u00e7\u00e3o, divulga\u00e7\u00e3o e hospedagem de sua campanha no momento da transmiss\u00e3o dos valores arrecadados, conforme a modalidade escolhida.<\/p>

3.5.<\/strong> Previously authorize the possibility of Ingesto providing your registration data to COLLABORATOR USERS <\/strong>whenever there is a breach of the promise of reward or a harmful event against them, in addition to recognizing the legitimacy of this act by agreeing to this TERM OF COMMITMENT<\/strong>.<\/p>

3.6.<\/strong> Not to take legal action against Ingesto or the COLLABORATOR USERS <\/strong>if the campaign does not achieve the expected success, regardless of the reason, cause or reason, especially due to acts carried out by COLLABORATOR USERS <\/strong>que frustrem doa\u00e7\u00e3o j\u00e1 realizada ou, de alguma forma, se arrependam.<\/p>

3.7.<\/strong> Caso haja o cancelamento ou a contesta\u00e7\u00e3o de pagamento de alguma contribui\u00e7\u00e3o realizada na campanha, O Ingesto<\/strong> is authorized to deduct, at any time, the amount of the canceled or contested contribution from the total campaign revenue.<\/p>

In the event that the CREATOR USER<\/strong> has already received the total amount collected in the campaign, Ingesto may, at its sole discretion, charge the amount of the canceled or contested contribution to the CREATOR USER<\/strong>, by sending a billing slip and\/or any other accepted means of billing.<\/p>

O Ingesto<\/strong> se reserva o direito de, na hip\u00f3tese do n\u00e3o pagamento dos valores acima mencionado, utilizar todos os meios de cobran\u00e7as aceitos pela legisla\u00e7\u00e3o brasileira e, inclusive, comunicar a inadimpl\u00eancia do Participante aos \u00f3rg\u00e3os e entidades de prote\u00e7\u00e3o ao cr\u00e9dito.<\/p>

4. Ingesto is not responsible for:<\/strong><\/p>

4.1.<\/strong> Due to the measures taken by COLLABORATOR USERS <\/strong>que visem frustrar a doa\u00e7\u00e3o ora conferida, independentemente de seus motivos, causas ou raz\u00f5es;<\/p>

4.2.<\/strong> Due to the unavailability of the Portal, the Ingesto<\/strong> will make every effort to make it as operational as possible, as already described in the website's Terms of Use Ingesto<\/strong>;<\/p>

4.3.<\/strong> For the frustrations that CREATOR USER<\/strong> eventually suffer as a result of the outcome of the campaign he promoted. O Ingesto<\/strong> does not have the legitimacy to interfere or control what COLLABORATOR USERS <\/strong>will execute.<\/p>

4.4.<\/strong> Pelos atos praticados pelo instituidor de pagamento escolhido, tal qual o valor das tarifas e descontos aplicados em virtude da cust\u00f3dia, armazenamento, retirada, convers\u00e3o do montante ou ato diverso que implique em pagamento pelo servi\u00e7o contratado, nas formas da lei e dos Termos de Servi\u00e7o do instituidor correspondente.<\/p>

5.<\/strong> The gift TERM OF COMMITMENT<\/strong> is governed by the laws of the Federative Republic of Brazil and by the International Treaties and Conventions of which Brazil is a signatory, and must be interpreted in the Portuguese language, with the Court of the District of the Capital of the Federal District being elected, with express waiver of any other, however privileged as it is or will be, to resolve any doubts, pending issues or disputes arising from this contract.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t
