Caso o benefici\u00e1rio se recusar a receber o que foi oferecido, os colaboradores n\u00e3o ter\u00e3o qualquer direito sobre o que foi enviado \u00e0 Ingesto, permanecendo o elaborador como o leg\u00edtimo detentor.<\/p>\n<p><strong>8.2.3.<\/strong> Em caso de descumprimento pelo Usu\u00e1rio Elaborador de quaisquer das disposi\u00e7\u00f5es da campanha criada, O Ingesto n\u00e3o ser\u00e1 respons\u00e1vel por realizar o que n\u00e3o foi cumprido, especialmente, mas n\u00e3o se limitando a entregar determinado produto ou realizar o servi\u00e7o prometido. Ingesto.com.br, by this TERM OF COMMITMENT the conditions for creating crowdfunding campaigns on the Ingesto website.<\/strong><\/p>\n<p>The Ingesto website is an environment based on trust, both by USERS CREATING campaigns and USERS CONTRIBUTORS. Therefore, if you do not agree with these provisions, do not proceed with creating your campaign.<\/p>\n<p><strong>1.<\/strong> This TERMS consolidates the good faith commitment of the CREATOR USER with Ingesto and the CONTRIBUTOR USERS of its platform, in addition to the Terms of Use of the Ingesto website, the knowledge and agreement of which by the CREATOR USER are mandatory, with the following conditions:<\/p>\n<p><strong>2. Ingesto undertakes to:<\/strong><\/p>\n<p><strong>2.1.<\/strong> Disponibilizar espa\u00e7o em sua plataforma para a divulga\u00e7\u00e3o e visibilidade das campanhas criadas pelos USU\u00c1RIOS CRIADORES, de forma a permitir que alcancem a arrecada\u00e7\u00e3o de recursos conforme a modalidade escolhida, \u201cTudo ou Nada\u201d, ou \u201cFlex\u00edvel\u201d, mediante o uso de um dos instituidores de pagamento disponibilizados.<\/p>\n<p><strong>2.2.<\/strong> Keep the amounts donated by CONTRIBUTOR USERS and, depending on the outcome of the campaign, transfer the amounts to the user who created it or return the amount to the participants, according to the characteristics of the campaign;<\/p>\n<p><strong>2.3.<\/strong> Make your efforts to allow only suitable and lawful campaigns in your environment. THE CREATOR USER undertakes to:<\/strong><\/p>\n<p><strong>3.1.<\/strong> Develop your campaign based on the principles of good faith, veracity and <strong>legality,<\/strong> fully complying with the Terms of Use of the Ingesto Portal, under penalty of taking the measures indicated in 2.3;<\/p>\n<p><strong>3.2.<\/strong> Execute the reward promises indicated in the description of the campaign created in its strict terms, bearing the costs of shipping, freight, transport, travel and other charges that are necessary to satisfy the indicated promise, under penalty of suffering legal measures brought by the CONTRIBUTING USERS;<\/p>\n<p><strong>3.3.<\/strong> Assume all legal demands that are motivated by its own action or omission, and must request the exclusion of Ingesto from the dispute and compensate it for expenses arising from legal fees and losses and damages it causes, in accordance with the law.<\/p>\n<p><strong>3.4.<\/strong> Reconhecer o direito do Ingesto em reter os valores atinentes \u00e0 presta\u00e7\u00e3o de servi\u00e7os para organiza\u00e7\u00e3o, divulga\u00e7\u00e3o e hospedagem de sua campanha no momento da transmiss\u00e3o dos valores arrecadados, conforme a modalidade escolhida.<\/p>\n<p><strong>3.5.<\/strong> Previously authorize the possibility of Ingesto providing its registration data to CONTRIBUTOR USERS whenever there is a breach of the promise of reward or a harmful event against them, in addition to recognizing the legitimacy of this act by agreeing to this TERM OF COMMITMENT.<\/p>\n<p><strong>3.6.<\/strong> A n\u00e3o ingressar com medidas judiciais contra o Ingesto ou os USU\u00c1RIOS CONTRIBUIDORES caso a campanha n\u00e3o obtiver o \u00eaxito esperado, independentemente do motivo, causa ou raz\u00e3o, especialmente por atos praticados pelos USU\u00c1RIOS CONTRIBUIDORES que frustrem doa\u00e7\u00e3o j\u00e1 realizada ou, de alguma forma, se arrependam.<\/p>\n<p><strong>3.7.<\/strong> Caso haja o cancelamento ou a contesta\u00e7\u00e3o de pagamento de alguma contribui\u00e7\u00e3o realizada na campanha, O Ingesto fica autorizada a deduzir, a qualquer momento, o valor da contribui\u00e7\u00e3o cancelada ou contestada, da arrecada\u00e7\u00e3o total da campanha.<\/p>\n<p>In the event that the CREATOR USER has already received the total amount raised in the campaign, Ingesto may, at its sole discretion, charge the value of the canceled or disputed contribution to the CREATOR USER, by sending a billing slip and\/or any other accepted means of billing.<\/p>\n<p>O Ingesto se reserva o direito de, na hip\u00f3tese do n\u00e3o pagamento dos valores acima mencionado, utilizar todos os meios de cobran\u00e7as aceitos pela legisla\u00e7\u00e3o brasileira e, inclusive, comunicar a inadimpl\u00eancia do Participante aos \u00f3rg\u00e3os e entidades de prote\u00e7\u00e3o ao cr\u00e9dito.<\/p>\n<p><strong>4. Ingesto is not responsible for:<\/strong><\/p>\n<p><strong>4.1.<\/strong> Pelas medidas tomadas pelos USU\u00c1RIOS CONTRIBUIDORES que visem frustrar a doa\u00e7\u00e3o ora conferida, independentemente de seus motivos, causas ou raz\u00f5es;<\/p>\n<p><strong>4.2.<\/strong> Due to the unavailability of the Portal, however, it endeavors to ensure that it remains as operational as possible, as already described in the Terms of Use of the Ingesto website;<\/p>\n<p><strong>4.3.<\/strong> For the frustrations that the CREATOR USER may suffer as a result of the outcome of the campaign they promoted. Children under 18 (eighteen) years of age, or any person who does not have full civil capacity, cannot use them.<\/p>\n<p><strong>2. Purpose of the Monthly Contribution Club<\/strong><\/p>\n<p><strong>2.1<\/strong> Objectives and tools<\/p>\n<p><strong>2.1.1<\/strong> The platform&#039;s objective, through its website, is to provide Users with a space to promote initiatives of any topic or scope, which cause some type of positive impact and require monthly financial collection for their activities. The MONTHLY CONTRIBUTION CLUB therefore makes it easier for Users to get to know each other, serving as a meeting point between people who need resources to make their initiatives viable, hereinafter referred to as \u201cCreators\u201d, and people who are interested in collaborating for the financing, hereinafter referred to as \u201cContributors\u201d.<\/p>\n<p><strong>2.1.2<\/strong> As a means of achieving its objective, the MONTHLY CONTRIBUTION CLUB offers tools that make it easier for Creators to make their initiatives viable through the collection of financial resources offered by Contributors in the form of a monthly subscription.<\/p>\n<p><strong>3. How It Works \u2013 Basic Rules<\/strong><\/p>\n<p><strong>3.1<\/strong> Submitting a proposal and publishing a campaign<\/p>\n<p><strong>3.1.1<\/strong> A publica\u00e7\u00e3o de uma campanha no CLUBE DE CONTRIBUI\u00c7\u00c3O MENSAL \u00e9 e deve ser feita atrav\u00e9s dos passos descritos no item 4.1, quando os Criadores devem responder um formul\u00e1rio no qual ser\u00e1 poss\u00edvel descrever a iniciativa e fazer a proposta de campanha.<\/p>\n<p><strong>3.1.2<\/strong> Sometimes it will be necessary to make adjustments to the initial club so that it suits the purpose of the platform. Other times, the club will not fit into the philosophy of the platform and the MONTHLY CONTRIBUTION CLUB team will have the autonomy to refuse such clubs.<\/p>\n<p><strong>3.1.3<\/strong> Once published, the MONTHLY CONTRIBUTION CLUB will have its own page on the platform, through which Contributors will be able to contribute monthly subscription amounts starting at R$10.<\/p>\n<p><strong>3.1.4<\/strong> The responsibility for the dissemination and fundraising of Contributors lies exclusively with the Creator, with the MONTHLY CONTRIBUTION CLUB team only facilitating this process, so that it cannot be held responsible for the success of the fundraising.<\/p>\n<p><strong>3.2<\/strong> Contribui\u00e7\u00e3o e pagamento<\/p>\n<p><strong>3.2.1<\/strong> Para colaborar com uma campanha, o Usu\u00e1rio dever\u00e1 (i) entrar na p\u00e1gina da campanha em quest\u00e3o; (ii) clicar no bot\u00e3o de chamada para apoio; (iii) entrar seus dados de login ou preencher o formul\u00e1rio de cadastro (iv) ler e aceitar os Termos de Uso do CLUBE DE CONTRIBUI\u00c7\u00c3O MENSAL; (v) colocar seus dados de pagamento, que ser\u00e3o passados diretamente para a operadora Wirecard, conforme descrito no item 5.1.<\/p>\n<p><strong>3.2.2<\/strong> Toda colabora\u00e7\u00e3o feita para uma campanha na plataforma do CLUBE DE CONTRIBUI\u00c7\u00c3O MENSAL \u00e9 uma assinatura mensal. Ao fazer uma contribui\u00e7\u00e3o, o Contribuidor se declara ciente de que aquele mesmo valor ser\u00e1 descontado de seu cart\u00e3o de cr\u00e9dito todos os meses, at\u00e9 que seja feito o cancelamento da assinatura pelo pr\u00f3prio Contribuidor ou por algum outro motivo externo, como falta de pagamento, por exemplo.<\/p>\n<p><strong>3.2.3<\/strong> O primeiro pagamento \u00e9 feito na hora da colabora\u00e7\u00e3o e a partir da\u00ed todos os pagamentos ser\u00e3o descontados no mesmo dia, nos meses seguintes.<\/p>\n<p><strong>3.2.4<\/strong> A partir do primeiro pagamento, o Contribuidor entra para a lista de Assinantes da campanha. Caso a assinatura seja cancelada por qualquer motivo, o Usu\u00e1rio deixa de fazer parte da lista de Assinantes.<\/p>\n<p><strong>3.2.5<\/strong> The Contributor may modify the value of their subscription or cancel it at any time they deem appropriate.<\/p>\n<p><strong>3.2.6<\/strong> The Creator will have access to the complete list of collaborations and their respective Contributors, including their registration data.<\/p>\n<p><strong>3.2.7<\/strong> Todas as transa\u00e7\u00f5es s\u00e3o gerenciadas pelo servi\u00e7o de pagamento Paypal (paypal.com), ou Tripe (tripe.com), inclusive a parte de seguran\u00e7a dos dados.<\/p>\n<p><strong>3.3<\/strong> Goals and Rewards<\/p>\n<p><strong>3.3.1<\/strong> The continuous fundraising system offered by the MONTHLY CONTRIBUTION CLUB establishes that goals must be designated by the Creators as a way of communicating to all Users the destination of the resources, as well as motivating collaboration and creating significant milestones throughout the process.<\/p>\n<p><strong>3.3.2.<\/strong> Goals are monthly financial amounts that the campaign wants to achieve for specific purposes. Each goal is made up of 03 (three) basic components: Financial value: the monthly fundraising amount you want to achieve; Delivery proposal: what will be done with the money if that amount is collected monthly; Reward proposal: a reward to be delivered to contributors.<\/p>\n<p><strong>3.3.3.<\/strong> Rewards are always linked to goals and are based on the concept of celebration. Unlike crowdfunding platforms with specific collaborations, in which a reward is delivered for each collaboration, in the MONTHLY CONTRIBUTION CLUB rewards are delivered whenever a goal is reached, as a way of marking this important moment.<\/p>\n<p><strong>3.3.4<\/strong> Rewards can be products, services, experiences (participation in courses, parties, workshops, etc.) or even symbolic (thanks, recognition, name in credits, etc.).<\/p>\n<p><strong>3.3.5<\/strong> It is not permitted to offer financial rewards as an incentive for collaborations, including, but not limited to: offering equity participation in for-profit entities or any type of security, as well as the promotion of raffles and sweepstakes. Esses benef\u00edcios nada t\u00eam a ver com as recompensas, explicadas no item 3.2, que marcam a conquista de uma meta financeira espec\u00edfica.<\/p>\n<p><strong>3.5<\/strong> The Role of Intake and the Creator&#039;s Sole Responsibility for Implementation<\/p>\n<p><strong>3.5.1<\/strong> The MONTHLY CONTRIBUTION CLUBE platform only offers the structure of its website and does not participate in the creation of the initiatives published on it, nor in their implementation. The campaigns run, the execution of objectives and the delivery of promised rewards are the exclusive responsibility of the Creators. Ingesto is not responsible, therefore, for the way in which resources are used, for the achievement of objectives and for the delivery of such rewards, for their veracity or their quality.<\/p>\n<p><strong>3.5.2.<\/strong> Eventually Ingesto may publish its own campaign. In this case, said information will be expressly published on your website and, solely and exclusively in this case, you will assume the responsibilities of a Creator.<\/p>\n<p><strong>3.6<\/strong> Possibility of post-moderation<\/p>\n<p><strong>3.6.1<\/strong> The relationship between Creators and Contributors occurs directly, without intervention from Ingesto, which only provides space on its website. Ingesto does not mediate business through the MONTHLY CONTRIBUTION CLUB platform. Ingesto, although it does not assume responsibility for the content generated by its Users, nor has any obligation to monitor its content, reserves the right to discretionally and at its sole discretion remove any content considered inappropriate from the website.<\/p>\n<p><strong>3.7<\/strong> The platform\u2019s philosophy<\/p>\n<p><strong>3.7.1<\/strong> THE MONTHLY CONTRIBUTION CLUB, like O Ingesto, exists to help bring to life initiatives that generate collective impact. For a campaign to be accepted on the platform, it must articulate what type of impact it generates and how the resources mobilized through the MONTHLY CONTRIBUTION CLUB will help expand this impact. All proposals will be analyzed by the MONTHLY CONTRIBUTION CLUB team, who will check whether they are aligned with the philosophy of the platform and Ingesto.<\/p>\n<p><strong>3.7.2<\/strong> Any campaigns with illegal, immoral, obscene, racist, offensive content or content that is in violation of morality and good customs or current legislation, or that fails to comply with any condition established in these Terms, are not permitted and may be removed from the air. Partisan political campaigns or campaigns with a religious promotion theme will also not be accepted.<\/p>\n<p><strong>4. The Campaigns \u2013 Details<\/strong><\/p>\n<p><strong>4.1<\/strong> Campaign publication<\/p>\n<p><strong>4.1.1<\/strong> Para publicar uma iniciativa no website e se tornar um Criador, o Usu\u00e1rio dever\u00e1 clicar no bot\u00e3o de lan\u00e7ar clube de contribui\u00e7\u00e3o, passando pelas seguintes etapas: (i) cadastro completo; (ii) leitura na \u00edntegra e com aten\u00e7\u00e3o deste Termos de Uso, Pol\u00edtica de Privacidade e demais regras de utiliza\u00e7\u00e3o do CLUBE DE CONTRIBUI\u00c7\u00c3O MENSAL; (iii) leitura atenta da apresenta\u00e7\u00e3o que mostra os detalhes sobre a din\u00e2mica; (iv) descri\u00e7\u00e3o da iniciativa por meio de preenchimento do formul\u00e1rio online; (v) detalhamento das 03 (tr\u00eas) primeiras metas e suas recompensas associadas; (vi) submiss\u00e3o da campanha e publica\u00e7\u00e3o pelo na plataforma.<\/p>\n<p><strong>4.1.2<\/strong> If the proposal complies with the conditions established in this term, after the process described in item 3.1 and its sub-items, the Creator will receive a campaign page on the platform, which will be available online to receive contributions from Contributors.<\/p>\n<p><strong>4.1.2.<\/strong> Campaigns that do not comply with the conditions established in this term will be removed from the air. The MONTHLY CONTRIBUTION CLUB team will inform the Creator of the reason and, eventually, the necessary adjustments so that it can be put back online.<\/p>\n<p><strong>4.2<\/strong> Filters<\/p>\n<p><strong>4.2.1<\/strong> The User can choose to display campaigns during their navigation, on the campaign listing page, including selecting additional filters and themes, or even searching by keyword.<\/p>\n<p><strong>4.3<\/strong> Monitoring of the Campaign by the Creator<\/p>\n<p><strong>4.3.1<\/strong> Uma vez que a campanha tenha sido publicada, o Criador ter\u00e1 acesso a uma \u00e1rea exclusiva de controle, onde poder\u00e1 acessar a qualquer momento o status de sua campanha, atualizar as \u00e1reas de novidades e presta\u00e7\u00e3o de contas.<\/p>\n<p>4.3.2 Once a month, when the amounts collected are transferred, the Creator will receive a report of the contributions received that month. Sistemas de Pagamento<\/strong><\/p>\n<p><strong>5.1<\/strong> Contribution through Wirecard<\/p>\n<p><strong>5.1.1<\/strong> Collaboration with financial resources will be done through the Wirecard system (www.wirecard.com.br). The Wirecard system allows the MONTHLY CONTRIBUTION CLUB to display the fundraising status in real time on the campaign page.<\/p>\n<p><strong>5.2<\/strong> Monthly Payments<\/p>\n<p><strong>5.2.1<\/strong> THE MONTHLY CONTRIBUTION CLUB uses the Wirecard Subscription service to generate monthly payments for campaigns. Every collaboration on the platform is considered a monthly subscription and will be deducted every month until the subscription is canceled by the Contributor, directly on the Wirecard website or by contacting O Ingesto.<\/p>\n<p><strong>5.3<\/strong> Receiving the money<\/p>\n<p><strong>5.3.1<\/strong> The total value of the monthly contributions, deducting the Intake fee (item 6), will be transferred to the Creator&#039;s Wirecard account, between the 15th and 25th of the month following the collection. The amount can be withdrawn in full at any time following Wirecard rules. Sponsors \u2013 Authorization to Place Brands<\/strong><\/p>\n<p><strong>7.1.<\/strong> The Creator, when using the MONTHLY CONTRIBUTION CLUBE platform, accepts and recognizes the right of Ingesto and its eventual sponsors to publish their brands in the \u201cCaptadores\u201d area.
