If you need to resolve any doubts regarding this contract, you can call us via <strong><a href=\"https:\/\/wa.me\/5531991498819?text=D\u00favidas%20no%20Contrato%20de%20Captacao%20de%20Recursos!\" target=\"_blank\" rel=\"noreferrer noopener\">Whatsapp<\/a><\/strong>.<br \/><\/em><\/p>\n<p>By this private instrument, signing between the <strong>PARTIES<\/strong>, <strong>INGESTO \u2013 INSTITUTO PARA GEST\u00c3O DO TERCEIRO SETOR<\/strong>, with an administrative office located in <strong>SEPS Qd. 710\/910, Conjunto D, Loja 28, CEP: 70.390-108, Bras\u00edlia\/DF, CNPJ 18.171.211\/0001-52,<\/strong> in this act represented by Mrs. <strong>Mary Barbosa dos Santos Ferreira<\/strong>, Brazilian, married, Consultant, Identity No. (MG-4.378.922), CPF No. (851.591.406-97), resident and domiciled at Rua Angaturama, n\u00ba 520, S\u00e3o Paulo neighborhood, CEP: 31.910-220 , Belo Horizonte\/MG<strong>)<\/strong>, contact email address: <a href=\"mailto:contato@ingesto.org.br\">contato@ingesto.org.br<\/a>, Presidente do Instituto, doravante denominada simplesmente de <strong>INGESTION<\/strong>, and on the other side the <strong>USER<\/strong> who must accept this instrument with all its legal implications<strong>,<\/strong> hereinafter referred to simply as <strong>VOLUNTARY<\/strong>, they have the following just and right among themselves:<br \/><strong>A) CONSIDERING<\/strong> that the <strong>INGESTION <\/strong>\u00e9 uma Institui\u00e7\u00e3o com experi\u00eancia no mercado de presta\u00e7\u00e3o de servi\u00e7os na \u00e1rea de capta\u00e7\u00e3o de recursos, angaria\u00e7\u00e3o de fundos via financiamento coletivo, crowdfunding, marketing social, ambiental, esportivo, de patroc\u00ednios culturais, tur\u00edsticos, isen\u00e7\u00e3o fiscal atrav\u00e9s de IR, ICMS, ISS, dentre outros, apta a prestar servi\u00e7os de apoio administrativo na capta\u00e7\u00e3o de recursos para Organiza\u00e7\u00f5es do Terceiro Setor.<br \/><strong>B) WHEREAS<\/strong> that the <strong>VOLUNTARY<\/strong> is a natural person who is available to act as a volunteer with the <strong>INGESTION<\/strong>, which qualifies you for the contractualization resulting from this contract.<br \/><strong>C) CONSIDERING<\/strong> that both, <strong>INGESTION <\/strong>It is <strong>VOLUNTARY<\/strong>, desejam uma parceria duradoura, <strong><em>WAKE UP, <\/em><\/strong>among themselves, the present is fair and right <strong>Contract of<\/strong> <strong>Presta\u00e7\u00e3o de Servi\u00e7os Volunt\u00e1rio<\/strong>, which will be governed by the following clauses and the conditions described in this instrument.<br \/><br \/><strong><u>DO OBJETO<br \/><br \/><\/u><\/strong><u><\/u><strong>Clause 1 \u2013 <\/strong>O <strong>VOLUNTARY <\/strong>will provide services related to its area of training, as well as work to achieve the objectives established by the <strong>INGESTION <\/strong>in all demands that are passed on to you by your <strong>collaborator <\/strong>and that are within their area of professional or educational knowledge, or even in those areas in which the <strong>VOLUNTARY <\/strong>demonstrate interest in working, and which are areas of activity of the<strong> INGESTION<\/strong>. Dentre as atribui\u00e7\u00f5es que podem lhe ser solicitado atrav\u00e9s de suas horas de trabalho est\u00e3o aquelas estabelecidas pelo <strong>INGESTION<\/strong>.<br \/><br \/><strong><u>OBLIGATIONS<br \/><br \/><\/u><\/strong><strong>Clause 2 \u2013 A <\/strong><strong>INGESTO will present <\/strong>to the <strong>VOLUNTARY <\/strong>the necessary conditions for the development of the activities assigned to it.<br \/><strong>Clause 3 \u2013 <\/strong>A <strong>INGESTION<\/strong> is responsible for informing the <strong>VOLUNTARY <\/strong>whether, for reasons of force majeure, it will release you from its services and whether this contract will be terminated <em>through official communication at least (30) days in advance.<br \/><\/em><strong>Clause 4 \u2013 <\/strong>If <strong>VOLUNTARY <\/strong>necessite, por motivo de for\u00e7a maior, alterar os dias e hor\u00e1rios da presta\u00e7\u00e3o de seus servi\u00e7os, bem como a rescis\u00e3o deste contrato, dever\u00e1 informar a <strong>INGESTION <\/strong>through an official communication at least in advance <em>from (30) <\/em>days.<br \/><br \/><strong>Clause 5 \u2013 <\/strong>O <strong>VOLUNTARY<\/strong> declara que \u00e9 detentor de todas as condi\u00e7\u00f5es necess\u00e1rias ao desempenho dos servi\u00e7os a que se compromete e que tem ci\u00eancia de que, no caso de acarretar danos a terceiros, sejam decorrentes de dolo ou culpa, poder\u00e1 ficar sujeito a arcar com os consequentes preju\u00edzos.<br \/><br \/><strong>Cl\u00e1usula 6\u00aa &#8211; <\/strong>O <strong>VOLUNTARY<\/strong> declara, espontaneamente, estar ciente e de acordo com os termos da <a href=\"https:\/\/www.planalto.gov.br\/ccivil_03\/leis\/l9608.htm\"><em><strong>Lei Federal n\u00ba 9. 608 de 18\/02\/98<\/strong><\/em><\/a>, que disp\u00f5e sobre o servi\u00e7o <strong>VOLUNTARY<\/strong>, cujo conte\u00fado est\u00e1 dispon\u00edvel no referido link.<br \/><br \/><strong><u>REMUNERATION<br \/><br \/><\/u><\/strong><strong>Clause 5 \u2013 <\/strong>The services provided by <strong>VOLUNTARY <\/strong>ser\u00e3o gratuitos, sendo de sua livre e espont\u00e2nea vontade a execu\u00e7\u00e3o deles e toda presta\u00e7\u00e3o de servi\u00e7os descritos neste contrato, bem como aqueles razoavelmente solicitados pelo <strong>INGESTION <\/strong>e de seus colaboradores e que concordou em realiz\u00e1-los.<br \/><strong>Clause 6 \u2013 <\/strong>Expenses for work carried out by the <strong>VOLUNTARY<\/strong> for expenses authorized in writing by the <strong>INGESTION <\/strong><em>(reembolso de um volunt\u00e1rio por despesas desembolsadas incorridas no decurso do seu voluntariado)<\/em>.<strong><u>\u00a0<br \/><br \/><\/u><\/strong><strong><u>TERMINATION<br \/><br \/><\/u><\/strong><strong>Clause 7 \u2013 <\/strong>Este contrato poder\u00e1 ser rescindido a qualquer tempo, por iniciativa de qualquer das partes, o que n\u00e3o acarretar\u00e1 qualquer tipo de indeniza\u00e7\u00e3o ao <strong>VOLUNTARY<\/strong> or to <strong>INGESTION<\/strong>.<br \/><strong>Clause 8 \u2013 <\/strong>A <strong>INGESTO criteria<\/strong>, any failure to comply with the expectations described below may result in the termination of this contract:<br \/>8.1. Motivations:<br \/>8.1.1. Treat all information passed on in a non-confidential manner <strong>INGESTION <\/strong>or that you become aware of through this contract;<br \/>8.1.2. All activities carried out during the <strong>VOLUNTARIADO <\/strong>are associated with the <strong>INGESTION <\/strong>and must be mentioned and credited to the <strong>INGESTION<\/strong>;<br \/>8.1.3. O <strong>VOLUNTARY <\/strong>undertakes to provide the <strong>INGESTION <\/strong>copy of all documents developed, created or produced by you;<br \/>8.1.4. O <strong>VOLUNTARY <\/strong>agree not to post photos, videos, texts or any type of communication on the internet related to the <strong>INGESTION <\/strong>without prior written authorization.<br \/><br \/><strong><u>TERM<br \/><br \/><\/u><\/strong><strong>Clause 9 \u2013 <\/strong>This contract lasts for 12 months and can be extended for an equal period at the discretion of the parties.<br \/><br \/><strong><u>VOLUNTEER PERMITS<br \/><br \/><\/u><\/strong><strong>Clause 10 \u2013 <\/strong>O <strong>VOLUNTARY<\/strong> a t\u00edtulo gratuito e em car\u00e1ter definitivo, irrevog\u00e1vel, irretrat\u00e1vel e por prazo indeterminado autoriza o uso de suas informa\u00e7\u00f5es e suas logomarcas\/imagens a serem utilizadas pelo <strong>INGESTION <\/strong>no portf\u00f3lio em seu site ou em seu material impresso, em aulas e palestras, assim como para a divulga\u00e7\u00e3o dessas informa\u00e7\u00f5es pelo <strong>INGESTION<\/strong> em e-mails e reuni\u00f5es de trabalho, com objetivos de angariar financiadores, patrocinadores, doadores e apoiadores, bem como para o pr\u00f3prio marketing da <strong>INGESTION<\/strong>, in search of other <strong>VOLUNTEERS <\/strong>ou outros tipos de atividades.<br \/><strong>Clause 11 \u2013<\/strong> O <strong>VOLUNTARY<\/strong> undertakes to disclose, if any, in its means of communication, such as: websites, blogs, websites, Facebook, Instagram, WhatsApp, Twitter, Linkedin and other social media platforms, the <strong>INGESTION<\/strong> as Mentor and Advisor according to the content described in this contract.<br \/><br \/><strong><u>COMMITMENT, SECRECY AND CONFIDENTIALITY<br \/><br \/><\/u><\/strong><strong>Clause 12 \u2013<\/strong> Todas as informa\u00e7\u00f5es t\u00e9cnicas, logins, senhas, acessos de plataformas de qualquer natureza, obtidas atrav\u00e9s da rela\u00e7\u00e3o entre o <strong>INGESTION<\/strong> and the <strong>VOLUNTARY,<\/strong> e relacionadas ao objeto do presente contrato, relativo \u00e0s especifica\u00e7\u00f5es, funcionamento, organiza\u00e7\u00e3o, desempenho ou qualquer conte\u00fado que envolva o <strong>INGESTION<\/strong> ser\u00e3o tidas como <strong>CONFIDENTIAL AND CONFIDENTIAL<\/strong>.<br \/><strong>Clause 13 \u2013<\/strong> For the purposes of this term, any and all information, whether patented or not, of a technical, operational, commercial, legal, <em>Know-how<\/em>, inventions, processes, formulas and designs, patentable or not, production systems, logistics and <em>layouts<\/em>, business plans <em>(business plans)<\/em>, accounting methods, techniques and accumulated experiences, documents, contracts, papers, studies, opinions and research to which the <strong>VOLUNTARY<\/strong> have access:<br \/><strong>13.1 &#8211; <\/strong>Orally.<br \/><strong>Clause 14 \u2013<\/strong> O <strong>VOLUNTARY<\/strong> undertakes to maintain confidentiality by not using such confidential information for its own benefit or that of others.<br \/><strong>Clause 15 \u2013<\/strong> Confidential information entrusted to the <strong>VOLUNTARY<\/strong> may only be opened to third parties with the prior written consent of the <strong>INGESTION<\/strong>, or in case of judicial determination, in which case the <strong>VOLUNTARY<\/strong> must immediately inform, in writing, the <strong>INGESTION<\/strong> so that it seeks to obstruct and remove the obligation to reveal the information.<br \/><strong>Clause 16 \u2013<\/strong> Confidential information does not include:<br \/><strong>16.1 &#8211; <\/strong>Now available to the general public through no fault of the employee;<br \/><strong>16.2 &#8211; <\/strong>That were already known to the employee before signing this contract and that were not acquired directly or indirectly from the <strong>INGESTION<\/strong>;<br \/><strong>16.3 &#8211; <\/strong>Which are no longer treated as confidential by <strong>INGESTION<\/strong>.<br \/><strong>Clause 17 \u2013<\/strong> All confidentiality and secrecy information provided for in this Clause will be valid throughout the term of this instrument, for as long as this contract lasts and, also, for a minimum period of <strong>02 <em>(two)<\/em><\/strong> years after the termination of this contract.<br \/><br \/><strong><u>LEGAL BINDING<br \/><br \/><\/u><\/strong><strong>Clause 18 \u2013<\/strong> O presente contrato, em raz\u00e3o de seu objeto e natureza, n\u00e3o gera para o<strong> VOLUNTARY <\/strong>any relationship of a labor or social security nature with regard to professionals and representatives of the <strong>INGESTION,<\/strong> as well as not having the <strong>INGESTION, <\/strong>any relationship of a labor or social security nature regarding the <strong>VOLUNTARY<\/strong> or possible representatives<strong>.<br \/><\/strong><strong>Clause 19 \u2013<\/strong> If necessary, the <strong>INGESTION<\/strong> assumes, in the activities described in the <em>caput<\/em> desse contrato todas as responsabilidades advindas das contrata\u00e7\u00f5es de terceiros, de plataforma t\u00e9cnicas ou aplicativos para a realiza\u00e7\u00e3o e execu\u00e7\u00e3o do presente contrato, nas responsabilidades as quais lhe cabe, isentando o <strong>VOLUNTARY <\/strong>any joint and several liability.<br \/><br \/><strong><u>THE PLACE AND TIME OF PROVISION OF SERVICES<br \/><br \/><\/u><\/strong><strong>Clause 20 \u2013<\/strong> The mandatory payments described in the caput of this contract and its sections will be provided within the business hours of the <strong>INGESTION<\/strong>, of <strong>9 <em>(nine)<\/em><\/strong> hours of the morning to <strong>17 <em>(seventeen)<\/em><\/strong> afternoon hours from Monday to Friday, preferably with a minimum weekly workload of 10 hours, on the premises of the <strong>INGESTION <\/strong>or in establishments of the <strong>VOLUNTARY<\/strong> as necessary, and can also be carried out via telephone, e-mail, Skype, WhatsApp, or other communication platform, respecting the aforementioned business hours or, due to the interest or availability of the <strong>VOLUNTARY<\/strong>, run them at whatever time is most convenient for you.<br \/><br \/><strong><u>GENERAL CONDITIONS<br \/><br \/><\/u><\/strong><strong>Clause 21 \u2013<\/strong> O <strong>VOLUNTARY<\/strong> declara reconhecer que a presta\u00e7\u00e3o dos servi\u00e7os descritos nesse documento n\u00e3o gera v\u00ednculo empregat\u00edcio, nem obriga\u00e7\u00f5es de natureza trabalhista, previdenci\u00e1ria ou afim; que inexiste controle de frequ\u00eancia ou exig\u00eancia de aviso pr\u00e9vio formal no caso de descontinuidade da rela\u00e7\u00e3o objeto deste Termo <strong><sup>1 <\/sup><\/strong>.<br \/><strong>Clause 22 \u2013<\/strong> Este contrato ter\u00e1 validade jur\u00eddica a partir do reconhecimento por parte do <strong>VOLUNTARY<\/strong> atrav\u00e9s de aceite do formul\u00e1rio que acompanha esse contrato.<br \/><strong>Clause 23 \u2013<\/strong> Hereby <strong>CONTRACT<\/strong>, O <strong>VOLUNTARY <\/strong>grants the<strong>\u00a0INGESTION <\/strong>e seus agentes autorizados, fornecedores, executivos, diretores, funcion\u00e1rios, licenciados, afiliados, sucessores, colaboradores diretos ou indiretos o direito e licen\u00e7a n\u00e3o exclusivo, irrevog\u00e1vel, perp\u00e9tuo e mundial de usar, reproduzir, exibir, executar, editar, criar trabalhos derivados e distribuir, no todo ou em parte, qualquer material, fotografias, grava\u00e7\u00f5es, textos produzidos, criados ou desenvolvidos pelo mesmo, bem como sobre seu trabalho <strong>VOLUNTARY<\/strong> realizado durante o atividades patrocinadas pela <strong>INGESTION <\/strong>, for any purpose, in any form or media now known or hereafter developed.<strong><u>\u00a0<br \/><br \/><\/u><\/strong><strong><u>ADDITIVE TERMS<br \/><br \/><\/u><\/strong><strong>Clause 24 \u2013<\/strong> This contract may be amended, modified, deleted and included any Clause, word or text at any time at the full discretion and interest of the <strong>INGESTION<\/strong>. Being the responsibility of the <strong>VOLUNTARY<\/strong>, periodicamente, verificar o conte\u00fado do presente contrato objetivando atentar-se as exig\u00eancias contratuais, bem como aos seus deveres e direitos.<br \/><strong><u><br \/><\/u><\/strong><strong><u>FROM THE FORUM<\/u><\/strong>\u00ad\u00ad<br \/><br \/><strong>Clause 25 \u2013<\/strong>\u00a0To the <strong>PARTIES<\/strong> elect the Forum of <em>(Brasilia DF)<\/em>, as the sole and competent person to resolve any claims arising from this contract, waiving any other, however privileged it may be, or may become.<\/p>\n<p>And, because they are together and hired, the <strong>VOLUNTARY\u00a0 <\/strong>signs and endorses this instrument presenting its acceptance.<\/p>\n\n<p>Doubts?
